I have a joint saving acc with my husband. He used to withdraw money without knowing to me. When i came to know, I approached the bank and they advised me to freeze debit transactions. I did the same as they advised. Now i am separated from husband and violence case is going on. I want to withdraw money fron that account for daughters admission. But the bank asked me to bring husband along. How is it possible for me to do this. The mode of operation is either or survivor. Can i move to court for remedy ?? Pls suggest. TIA

A.move one application with the bank higher authorities for getting your bank account unfreeze. and if it donot work, approach banking ombudsman and that will surely work. for more details you can contact me also through this webiste administrator and can get my details. approaching court will make your husband alert also and will linger on the process too.

A.1) You have done mistake by taking advise from the bank persons. Have they given you in writing about their advice?
2) When you can to know that Husband is withdrawing money from that account due to E or S option by you both, YOU should have withdraw all the BALANCE & THEN LEFT THE ACCOUNT WITH MINIMUM BALANCE without Freezing it.
3) Now go to the bank & tell them as I have freezed the account, now tell them that I am giving in writing to unfreeze it. Get it done from the person who has advised it.
4) Since when are you both separated? See if you r husband can come to the bank for his daughter work, probably he will come, just give it a try. OR Better if you can get it done from the Bank authorities itself, they have misguided you & your hard earned money has been parked in an inoperative account. Hold the bank authorities liable for the same
5) Going to court & getting the orders is not an easy task, eventually you will be wasting your time.

A.1. File an application before the court, directing your husband to appear before the bank on a given date and time to unfreeze the accounts.
