I own a flat in Mumbai in a reputed society. I want to gift my flat to my daughter is society n o c required for making gift deed.
A.Dear Sir,
Yes you must get NOC or else at least you must intimate them and wait till their positive reply. Otherwise you have to go appeal before the Deputy Registrar and then to Civil Court etc.

A.U can gift your flat to your daughter by registered deed.After registration your daughter will become the owner, then she will finally intimate to the society.Better go through the content s of flat sale deed.regarding any condition by the society before gifting the flat to your daughter

A.Whole you make a gift deed Society has no right to interfere , means its NOC is irrelevant. But Society`s NOC will be required after becoming owner of your flat, such owner has to seek to include name in Society`s membership. What I mean is a society cannot restrict whatever rights are given in TP Act.
