Can a private car driving license holding driver ,drive a commercial car?

The car was in uber. so it was commercial. but another person with a private driving license was driving it and he hit the car. so a case is going on and there is a problem in claiming the insaurance. because he has an LMV license but not an LMV Cab one. however, I read an article that supreme court ordered that this is possible. the order was done on July 2017 by a 3 bench judge sitting. Has it happened?

please help!

A.Yes it is happened. You can drive a commercial vehicle on your private lmv licence.

If your claim is repudiated by insurance company you may file a consumer complaint before district consumer forum and another option, you may approach your insurance company and submit the supreme court guidelines and notification of transport ministry of India regarding lmv vehicle driving.

A.Yes this preposition has been elaborate and discuss by Hon'ble Supreme Court. DOnt worry if you have filed claim petition before MACT then, tribunal will pass the claim and if any driving rule has been violated by the driver of the Cab/Car then in that case Insurance company would have recovery rights from Driver of Cab/Car.
