A.Courts have given judgements that rape can be proved without medical test. But in the instant case the girl refusing medical test weakens her case.Consensual sex , if the consent is free is not rape.

A.Medical examination is the best way to prove and establish rape but that does not mean that in absence of medical examination it can not be established. The witness and facts and circumstance can be taken into consideration to establish that.

Consensual sex being rape depends upon few facts like what was the age of the girl, was there any promise to marry to her etc.
