Sir,
I made a complaint against SHO, ATO, and SI with vigilance and Dcp for not filling proper charge sheet and colluding with accused people in Hon'ble court.
Now through RTI I received the status that vigilance and Dcp fwd my complaint to Acp for enquiry. In same RTI I received a copy of report prepared by same accused SHO to Acp that I (complainant )if not satisfied with filed charge sheet than I could move to court.
1. Is there not a duty of vigilance and Dcp to set up the enquiry against erring police officials?
2. Accused Sho is filing report on allegations against himself. Is it legal?
3. In RTI, I received 2 reply
1 is that enquiry is pending with Acp and
2 They provided the report prepared by accused Sho? What does it mean?
What are the remedy available now?

A.1. The Writ petition will have to be filed with high court to summon the IO to provide his / her justification for why he / she not filing the charge sheet.

2. discuss with your current lawyer on the same.

Sir,
Thanks a lot sir for your reply. Please read my question again. As the IO had already filed the charge sheet but not in proper sections. As there are two accused made by IO only put 65 and 66C of IT Act. Whereas according to my knowledge there should IPC also attached to it e.g. if two accused made by police then the conspiracy act should be there. One accused is my relative who used my PAN no to access my Online Income Tax Account, so breach of trust is there and so on.
Please suggest.
