Sir.. my name is diksha.. I married a guy name akash.. he is having an extra marital affair.. I still can't leave him coz I don't have any financial support.. I just asked him to leave all these things and del the photos of those girls.. now he is not ready to b with me.. but not even taking a legal action.. please suggest me what sections can I impose upon him

A.1. Just because you need financial support, you do not have to bear his extra marital affair. Now its extra marital affair but in future, it may extend ruining your life.

2. Committing extra marital affair is an offence of 'Adultery'.

3. I suggest you to file a police complaint against him under the charges of Domestic violence, Harassment,Adultery .. etc.,

4. Better consult a lawyer before initiating cases against him.

A.File domestic violence case against him and ask for protection, separate accommodation and maintenance. Besides these you can take help of police for filing criminal complaints against him.

A.U can file a domestic violence case against him and also take protection orders.U can do all this without leaving ur husband's home.protection order will prevent him from forcefully throwing u out of ur matrimonial home.

A.Dear Sir,
Courts cannot do anything unless you can stand on your legs and fight. Just do the reverse and get a false boy friend, and see if his conduct may be changed. Get half salary and have some savings before you start fighting. You may take the following best course by filing DV case.

PRAYER
HENCE THE APPLICANT HUMBLY PRAYS
A) to take cognizance for the offence punishable u/s 498A IPC and punish Respondent No.1 to 3 as per law and extend police protection to the deponent,

B) Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.

C) Pass orders u/s 18, in totality against Respondent No.1 to 3,

D) Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.

E) Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent No.1 as he is residing in the house of respondent No. 3, which is legally prohibited,

F) Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent No.1 falsely filed Divorce Petition.

G) The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,

H) That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.

A.Diksha,

you can file a case under domestic violence against your husband, in addition, you can also file a case for getting monthly maintenance as provided in section 125 Cr.P.C., and,
most importantly, you can and you should make a police complaint against him stating complete facts about said women, with whom he is having affair, and he can be booked for adultery for such activities in addition to section 498a(cruelty) and other relevant section/s.
