Road traffic accident

I was involved in a road accident in India, 2 bikes hit each other. I was seating on the back seat of 1st bike. I got a severe mouth/head injury. My bikes driver is in ICU still serious and another driver died. Can the law and the deceased family members can punish me in any way i.e - compensation for the deceased family or jail, as I was not driving but drunk?

A.Hi,
You will be liable if it is established that you or the rider were at fault, or if he did not possess necessary qualifications to ride legally.
This claim will be sorted in the Motor Vehicles Accidents Claim Tribunal.

A.As you were not driving, you are not responsible for the accident. Your involvement in the case will be as an witness. You have not mentioned under whose name the vehicle was registered.
