Sir,
My wife is alleging DV in divorce, 498a etc, maintenance but she did not filed any separate case of DV against me since she separated from 2016. Is there any benefit of non filing of DV against me in other cases.

A.You have no advantage due to your wife not filing DV against you, as first of all it is her option, and secondly 498A contains some similar ingredients. Your only solace is in DV she could have asked for compensation.

A.DV case be filed any time.
There is no statutory limit for filing of case under section 498A or Domestic violence, however, one has prove the 'violence' or 'continuation of violence' in such cases. The burden of proof always lies on the complainant.

A.She can file it any time during pendency of divorce too. Don't give clue her regarding this.
