For any sort of leakage damaging the below flat .
is the society to bear the repairing charges or the owner from who's flat leakage is there or the below owner also has to share it if yes what is the ratio and what role society has in such cases and legal option if situation out of control

A.what are the by laws of your society say. Basically the builder is responsible for this kind of damage. Low quality material may be the reason for the leakage. Issue a legal notice to the builder

A.This question keeps coming up very often and unfortunately there is no direct answer for this. The way it has to be handled is that the Society must have specific bylaws for such matters describing at length that whose responsibility it would be. That would help all the residents and the owners time and effort.
Secondly if the society does not have specific bylaws then let it administer the dispute between the two floors and decide in what ratio who would bear the cost.

A.Inside the flat leakage between two flats the concerned flat holders should get it repaired at their cost.
First file complaint with society and also file complaint with Municipal Corporation about the leakage.
Society will not bear such repair cost.

A.Kindly refer your society by laws and it must be incorporated over there that in case of any internal leakage or damage, who will pay for such. In normal circumstances it is the owner from whose flat leakage has arose.
