My wife and I are living separately for the last 8 years. I am attending to the requirements of my two children who live with her. She is earning equal to me. She is not willing for divorce with mutual consent. Is it possible to file for divorce without going into instances of cruelty etc and just stating that we have been living separately for 8 years. Is ut easier to get a legal separation?

A.yes, in your circumstances grounds of cruelty are not required for seeking a divorce.

If you and your wife living separately since last 9 years then u can approach to family court for divorce on the ground of dessertion.

A.Yes you can file divorce even if there is no cruelty on your behalf. You are living separatly since last 8 years so marriage has broken irretrievably. Court would grant divorce to you

A.File divorce petition with the factual situation, if there is no cruelty. Based on the facts, there is cruelty because the family is living separately.

A.yes judicial separation is a remedy if u dont have future plans of second marriage. But you must have ground fot judicial separation and in your case desertion is a good ground.
