I have registered the rental agreement to my tenant in the sub-register office for the period of 5 years and now 2 years completed. But now the tenant suddenly vacated the house with out any prior notice ( as per the agreement the notice period is 3 months) .Two month rent is still pending and the tenant did not yet handed over the keys as well. Can I be able to file a case against the tenant.If possible please advice me of the same to proceed

A.dear client See agreement of any kind binds the parties signing it. In your case you can file case against tenant in rent control authority in your city according to your agreements.

A.You can proceed against the tenant as per the rental agreement terms of notice period, better to issue a legal notice on all aspects of the rental agreement and file a suit for recovery of unpaid rent and notice period rent before the Rent Controller Authority.

A.You need to see whether there is any locking period for the tenant. If it is there then you can recover the rent for the complete lock in period.

A.See agreement of any kind binds the parties signing it. In your case the tenant was bound to honour the terms which he has breached. So yes you can take legal action against him.

A.Yes you can file a case against the tenant. File an eviction suit to get possession of the property. His properties present in the premises can be attached for recovery of rent due
