My grand father was expired on last January, he has a account in post office with no nomination , Bank demands letter of administration.

Please guide from where we issue letter of administration.

A.Dear client! Please contact the concerned bank regarding the death certificate of your grandmother and getting the succession certificate from the concerned District Magistrate. It is possible that your work is done.

A.Dear client You need to be obtain the Legal Heir certificate or succession certificate as required by the postal Authorities from the competent court of jurisdiction. even you did not mentioned of any other surviving heir of your grandfather. If there is then you should not apply on the self earned asset of your grandfather. Instead you should apply for Succession Certificate, give equal rights for others to come forward and make their claim.

A.Post office has procedure to release or transfer the proceeds to nearest legal heir with the help of indemnity bond from two witness who can vouch for the legal heir knowing more than 20 years in the locality, or as required by the post office manuel.

A.You are mistaken ( and successfully confused several lawyers her too )about letter of administration, there will be no such thing in your case, neither an administrator. All you need is a succession certificate. but for claiming small amounts you may be required to execute a bond and an affidavit, it is so provided because if the amount you may have to spend on getting succession certificate exceeds the amount that you seek to recover.

A.You did not mentioned of any other surviving heir of your grandfather. If there is then you should not apply on the self earned asset of your grandfather. Instead you should apply for Succession Certificate, give equal rights for others to come forward and make their claim.

A.If the amount in post office account is up to 10 lakhs, then you may file application before the administrator general and you may be able to get letter of administration at earliest possible time from the said office.

A.You can apply legal heirship certificate from the Tashildhar and submit the same to the bank. Getting a order from court will take time.
