Sir/mam
I have taken a room on rent for my office started work from there and I gone in to lose my business so I told her I am going she told me take out this electrcity meteor and take hour stuff from the office that time I don't have money to pay the electric bill
After few months when I paid the bill now she's saying give me the rent of rest of months and using all my stuff

A.Did you serve a termination notice ending the tenancy? If you go through your tenancy agreement (leave & license agreement) you will find a termination clause clearly spelling out that either party can end the tenancy by serving one month notice. You just can't verbally say and walk away from your liabilities. Your tenancy continues till you serve one month legal notice of termination.

So your landlord/landlady has a legal right to ask you to pay the rents dues. However, she cannot use your articles without your written consent, which eventually leads to criminal breach of trust. She cannot confiscate your property to realize rent dues without Court's order.

Your property is your property so you should lodge a complaint in the local police station on such grounds. If police do not take your complaint then you can write to SP/CP and thereafter file a criminal proceeding u/s 156(3) CrPC against your landlord for breach of trust and also file a civil suit for recovery of your property and claim damages.

As for her to realize the rent dues, she has to serve a legal notice of termination and thereafter file a civil suit for realization of the rent dues, which may take years to get decided. A fit case to contest. Contact a local lawyer from Vidhikarya.

A.Sir, if you are clear all dues with damages then pretty sure to get return your all stuff. Because whatever happened with your business you must to clear all bills and dues.if you were already clear all bills rents and dues then send them legal notice for returning back your stuff.
