False allegation of Harassment

Dear Sir,
I have wife and 8 months daughter. Our marital relationship crossed 1year and 6 months.Between these period many times clash and argument happened between us. My wife always threatened to do suicide through knife, or other means. Later she and her family is threatening to file harassment case against us. I am thoughtless to what to do in this case. In future she and her family can file harassment case against me and my other family member. To save my other family member I separated myself from my parents and living with wife. Is there any means or precautionary measure to save myself and my family in future if this false allegation will appear.

A.Lodge a complaint in the local police station of such threats of suicide and false cases u/s 498A and Domestic violence against you and family members and for this reason you separated from your parents. Tell your parents also to lodge a complaint against her on this grounds. This will be your shield and can be used as a reference if she files a false case.

File a divorce petition on the ground of cruelty. However you will loose the custody of your baby girl as she is only 8 months old. SC ruling that mother will get the custody of the child till the age of 5 years, thereafter the biological father gets the custody of the child once the child is above 5 years.

You will have to give maintenance for your wife and the child in the meantime. However if she remarries after divorce, she will not be entitled to get maintenance.

A.You are residing separately but yet feel that you may not be harassed.It can be reality also and your illusion also.It will be better to install a CCTV camera in the house in the name of security and save recordings..it may be a evidence in future.

A.Answerd by Adv kavery Anand Bangalore.sir if possible gather some evidence pics or voice recording of ur wife while threating suicide by knife.or any other.. and even their family member's threatings...then if u have solid proof for this ...

Then let them file any case on u ... U can prove in the court that all allegations r false.

A.Firstly Send them legal notice through lawyer
