Need to claim fd with no Nominee

Hello
My aunty had FD and while opening she did not keep any nominee. She died couple of years back. Her husband (my uncle) is alive.
Couple of months back we meet the bank and manager asked us to provide the death certificate of my aunty and relationship certificate with my uncle.
We have submitted those docs and banker told in FD name and Death certificate name is not matching, hence we can't give u the money. Please help how to go now.

A.Ask the bank manager for the claim settlement booklet and complete it, it will take some time in the process.

A.You have to approach the bank manager for requirement for releasing the FD. You can also furnish the declaration as required by the bank with two witness of residential of the same locality who know the husband & demised wife for more than 20 years or as the case may be. Along with the change of deceased name as per the record with the bank and death certificate.

A.You have to check out and correct the death certificate and legal heir certificate issued by the RDO/Tehsil and if any documentary evidence like,Ration card,Driving license,Passport,etc.which proves that you are the relative of the deceased then Bank authorities would not have any objection is withdrawing the money.There are no big formalities as such like affidavits,succession certificate,etc.Don't worry in case of more help contact with vidhikarya lawyers.

A.If the findings mismatch with bank record, FD will not be released. You can either -
(i) file a petition for Succession Certificate in the High Court or
(ii) get Affidavit for correction of name in Death Certificate and thereafter approach Municipality/Corporation/Hospital for a corrected Death Certificate.

A.Please contact the higher bank officer for the help as they will verify all the documents and they may take indemnity bond from you for releasing the money.
In case, if they are not able to help you then you will have to take legal steps like sending Advocate Notice to the Bank for getting the money back.
