wife has filed a complaint in women cell against husband & his family in regards to day to day fight and after husband asking her to leave the house in anger. the case was suitably defended by husband and suggested to stay separately on rented flat. wife denied stating salary of husband is less and she cant compromise on less salary- If husband father gives in writing he will pay rent then she will come. police took the statement and close the case from their end as demand is not practical.
later husband sent 2 notices to come back and stay on rent.. she denied stating salary is less and cant compromise on lifestyle . she will come if husband buys new house or same maternal home house; husband is not comfortable to get wife in same house as wife has put lot of allegation on husband & in-laws which is related to 498A & domestic violence.
later wife has file petition in family court with again lot of allegation & put condition to pay 40,000/- out of 70,000/- salary or buy new house for her or will come to stay in same maternal house. because of child husband took a loan from bank and said to come and stay after closing all complaints. On 5th counselling at court ..wife said will come and stay at new house only on trial basis . husband denied stating if she wants to stay on trial then she could be have come in rented flat ; after taking loan and buying flat she wants to stay on trial and check my behavior.
On husband denying the same.. wife has now file domestic violence case by adding husband brother and bua ( she even does not stay with them ). what should be the next - all the allegation are false and fabricated story- wife does not pick the phone of husband as well, so that child can talk to father
Better challenge all such false cases by approaching high court by filing quashing petitions under section 482 of Criminal procedure Court. You must defend your self by engaging a senior advocate and avoid to pay any maintenance.
File a petition to quash the FIR u/s 482 Crpc before the concerned High court.
