My mother suffered from cancer and took a loan of rs. 7.5lakh from hdfc in november 2017 for treatment. But unfortunately in December, she expired unexpectedly because of sudden increase in the disease. (She was divorced)
The Loan Amount was 7.5lakh but 3.90 lakh was sent to DD To cover old loan from another company and the rest was credited in her account .

My age is 20. I am single daughter without anyone else help.
The problem is that: The DD is still not received . Now i have settled the old loan through cash because we did not get the DD. I have paid 3 EMI's of 16k of hdfc after my mother's sad demise. From past 6 months i ve complained regarding this issue of DD, they (bank officials) always tells me " pay this month emi we will find ur DD (According to them its misplaced) and then settle your loan" .

For loan settlement they will liquidate the dd and for covering the rest of the amount they are demanding 1-2lakh from me ( i am the only legal heir) . Now i am not capable of paying the emi ( already paid 3 emi's ) as well as give them 1-2 lakh settlement amount. I have just got a job which gives me no more than 18k as salary how will i survive if they forced me to pay. Iam not getting any financial help from anyone .

What should i do? Am i liable to pay? Or can the file a legal notice against me? Can u guide me what can Ido here to protect my job and to successfully settle the loan

A.Dear client you need to send legal notice to concerned authority and file complaint before banking ombudsman.

Now they r claiming that the loan was taken for home renovation. (They have ticked that in the form filled earlier for taking the loan) and telling me to give the emi or else they will move the case forward saying u gave the wrong reason to avail the loan .
What can i do ?

A.Dear Madam,
Get issue a legal notice and also approach the Banking Ombudsman to resolve the issue.

A.Dear Client, who took the loan you or your mother? If she took the loan then you are not responsible to payback the loan. If you took the loan or you were the co-applicant then yes you have the liability to repay the loan. Assuming that you are also the applicant and then in that case if you have tried to pay through the DD and if the DD is lost then the bank can mark that DD as lost ans return the DD amount from the DD issue account to your account. It seems the bank is taking you for a ride by saying that DD is lost and they will take time to find it. It is not the usual bank process. I would suggest that you speak to and get all the understanding. I am an ex SBI officer too.

No They cannot do that. Can you please share all the documents related to the loan to my mail id and also you will have to go for paid consultation now. In likelihood you will have to send a legal notice to the Bank and ask him to stop doing all this or else you will initiate legal action against them.

A.In my opinion you are not liable to pay any outstanding amount of personal loan taken by your mother to the bank. Moreover the hdfc bank at the time of disbursement of loan amount generally obtained a insurance policy to indemnify the amount of loan in case of death of customer. First you should contact with the manager of the bank and enquire about the insurance policy or ask the details of the instalment.
