Unethical demanding of maintainence

In 2007 I got registry married with my gf. In 2012 we started to stay as husband n wife but she left me after 4 months as i lost my job. After 2 years we become together again as i get a govt job. But after couple of months she demanded to stay separatly from my mother so she left me again. Now she charge IPC 125 agisnt me . Meanwhile I came to know she married a muslim guy secretly for last three years . I know the address where they r living. My question to u sir, what legal steps should I take that I can get rid off her without giving a single penny and get divorce.? Plz help me

A.If you know the name and address of that muslim guy, in your objections to Sec. 125 make the allegation that she has illegally married that guy and ask the Court to summon him as witness. He will not deny the marriage in Court.

A.the onus to prove upon you that she got marriage with an another guy ,if u could prove, no penny can be given to her as maintenance u/s 125 of Cr. P.c but if u could not prove it liable to face defamatiion and crueltyagainst her.
2nd quarry u have to prove her that she asked u to leave yr mother and the circumstances which records cruelty against u and yr mother lonely as this is a cruelty against you

A.If u are able to prove by producing evidence that she left you on her own wish and that she has remarried then u will not be liable to pay maintainence and will be entitled to divorce. U can also file a complaint for section 494 IPC against her but only proper evidence otherwise filling of such complaint without evidence may even go against you.

A.You have very good grounds for divorce. You need not to pay anything if you have proof regarding your wife committing adultery. You should take phone consultation.

A.list the consequences of such activity by a woman:

Ground of Divorce, adultery under sec. 497 of the Indian Penal Code and also bigamy, means being married to more than one at the same time. On conviction, as per sec. 494 of the Indian Penal Code she shall be punished with imprisonment for seven years maximum, with fine.
Such second marriage will be illegal. It will amount to adultery. First husband can take divorce based on evidences of second marriage. Such woman will go to jail for 7 years for bigamy.

Sir wife shall not be punished as an abettor. Only the men will have to suffer in such case.
