Mine is a Private Limited Company. One of my client is threatening to file a case against the Directors and the company demanding a refund. So the question is that the client is from Mumbai and we are Delhi based, so where the case will be filed? In delhi or in mumbai ??

A.dear client on an assumption of an agreement being absent, in your case the case can be filed in Delhi as well as in Mumbai but the chances of filing in Mumbai is more probable in nature.

A.The jurisdiction to file the case is where the cause of action arises or where the party resides.

A.Jurisdiction depends upon many criteria fro example; 1. Place where the cause of action arose, 2. The official address of the parties involved, 3. The jurisdiction mentioned in the agreement document signed and executed between the parties. 4. The agreement mentioning the place of shipping and delivering of goods etc. You need to be sure about all or else share your documents with a lawyer to find out the jurisdiction.
