My husband is a Central Government employee who cheated me in terms of Dowry and I have filed a case against him in the station. However the case crossed 90 days at the station and the police has not taken any action for the loss (loan) incurred. I am unable to repay the money and he is also left me and not living with me anymore his phone number has been changed and we don't have any contacts with him in spite of the police contacting him on his old number he and his family are not responding they come to the station and just run away from the station without any conclusion I haven't filed the charge sheet yet kindly let me know how can I proceed this case further. Whenever he comes to the station he has brought some politicians along with him to the station for influence and therefore the case is not moving any further

A.Giving and taking dowry is an offence under the law. In your case if you allege that it was dowry then you are equally guilty under the provision of section 3 of the Dowry Prohibition Act. If was better if you had raised your complaint for criminal breach of trust, cheating, 498A and domestic violence. Need to review the copy of your complaint, to determine what would be best for you to do.

if the police station refuses to register the FIR, then you may also approach the Superintendent of Police of the district requesting him to direct an investigation under the provisions of Section 154(3) Cr.P.C. However, if you do not receive any satisfactory action even after complaining to the Superintendent of Police, then you can file an application to the Magistrate having jurisdiction under Section 156(3) of the Cr.P.C.

Parallely you file an insolvent petition before DRT for declaring you as insolvent so that Creditor Bank do not bother you for loan. File a maintenance petition and get divorce on the ground of cruelty.

A.You should meet higher official at the Police station and insist on taking the matter further by filing charge sheet. This is cheaper than approaching High Court for direction. Tell the police that there is nothing they can get by calling other side in this type of complaint, because investigation will not yield anything.
