Hello Legal Experts.

My cousin who lived abroad along with her husband was influenced by her husband's family to sign the mutual consent divorce petition and her husband signed it too since he was influenced by his family.
The First motion is done and the 4 more months are left in the cooling-off period.

My cousin wants to save her marriage and would like to withdraw the petition by unilaterally and she has not availed any benefit during first motion . Since, the case is pending before the family court in the boy's native, she fears that the common lawyer appointed by the boy's family will know when she files the withdrawal application.

The boy lives abroad is expected to be here only during the second motion. Can the boy's father influence the family court and get an ex-parte decree divorce even after withdrawal by one party.
The boy may not openly say that he is still interested to pursue the marital obligations since his family has influenced and threatened him to come to this decision.

1. Will the family court dismiss the petition right after unilateral withdrawal application is submitted or will it wait until the second motion to hear both parties to take a decision.

Your opinion will be highly appreciated and all my cousin prays for the dismissal of this petition

A.I agreed with advocate manjula. There is proper procedure to file caveat. kindly go through with experienced family court lawyer.

A.Yes can move petition through advocate or from panel of Vidhikarya that the MCD petition filed earlier before the court was under undue influence and coiersion and justify with facts and circumstances, now your want permission to file petition for conciliation and also personally pray before the presiding Judge on the designated date of hearing .

A.She can file a petition withdrawing her consent in between also. However, the case will be posted for its hearing. She can try to file a petition to advance the hearing. But it is not likely to be allowed. One the date of hearing, it is necessary that the wife clearly states to the Judge that she is not willing for the divorce and wants to live with her husband.Even thereafter, the Judge may give another hearing date. On the next hearing also, the wife should be clear. If there is any threat of violence, please make a police complaint. If you further fear that the husband may try to fraudulently get divorce in ex parte by giving wrong address of the wife, please file a caveat.

What are the chances that the case will be dismissed when the wife says no in front of the judge and firmly states that she wants save her marriage.

Should the wife let the husband know that she has filled unilateral withdrawal application and if the court decides to advance the hearing what are the chances the mcd stands cancelled in this situation.
Please help

If she is firm on her stand, the petition will be definitely dismissed. the chance is 100 %. Later the husband would have to file a fresh petition, not by mutual but a normal divorce petition and serve the petition on the wife.
