We have a house on 40/50 plot in Bangalore which was in my mother's name which we gave the Katha to my elder bros name. We are 4 people one sis and another brother. My elder brother expired last year he was in u.s.a.his wife and son are also there. My another brother is residing in that house for past 45 yrs and he is not doing anything . If we want to file a partition suite to whom should we give notice? What is the legal procedure? We had given an affordavit to my elder brother to transfer Katha in his name to set right documents. Now he is expired what is the procedure?

A.You did not mention whether your mother is alive or deceased. If your mother died intestate then file a partition suit and make all surviving heirs defendants. Contact a local lawyer from Vidhikarya.

A.Dear client that might be possibility about any transaction upon that property since 45 years.if you want to get that property or share then you need to go through property lawyer for filing partition suit with merits.

A.45 years is a very long time. So please check if he has already sold away the property to someone else. If not, then your path may be simpler. You have to file a suit for partition and implead all your brothers and sisters (or their legal heirs) as defendants. But if he has already sold away the property, you would have to try and set aside that transaction first.

No he has not sold it but the Katha will be in my elder sister in law's name after my brother's death . She has given her GPA to her father. Should we give notice to her in usa or to another brother who is residing in that house.

Yes, you would have to implead everyone in your Suit and try to set aside the Kathas and GPA first and claim partition later or simultaneuosly.

I am a married woman married in 1988. Both my parents and elder brother whom we have transferred the Katha have expired and my brother wife is in USA. he has a son and another brother is staying in my mother's house and sister is a widow and having two studying children . To whom should we file partition suite.?
