I have been offered a job of assistant managet in canara bank. They exam was conducted by ibps. During the exam they captured the biometric and the same was not verified during examination. So they sent the samples to the forensic department and they cleared my identing and i have joined now. But i have waited for 6 months during which i didnot get any salary. There is not fault from my side because it is the fault of the person who taken my procedure or may it is the process which they followed because they failed to do it. It is their responsibilty to take care of this type of problems and should take care of some other alrernatives. Why should i loose my 6 months salary for the mistake i have not done. Will i get the salary if i go to tribunal. As there are some cases like suspension of a person and later he is not proven guilty they provide him the salary. This is the same scenario. Can i proceed to tribunal

A.The fastest way will be to send a representation to your organization asking them to disburse your salary. If they don't do it then you file a writ petition in the High Court and that should resolve your matter fast depending on the time taken by the court.

A.Since your designation is that of a Asst Manager, you do not fall within the definition of the workmen. Your employment is covered under S&E Act. Need to review your appointment letter. Give a legal notice through an advocate and wait for their reply. Thereafter either file a writ petition before the high court having jurisdiction or file an application under insolvency and bankruptcy code 2016 for the release of the salary before DRT.

You may approach tribunal or high court and you will get six months salary easily.
