Sir
I am in sale agreement of my land on 17.01.13 get advance 3lacs and sale registration is proposed on 28.02.13.now buyer not able to arrange remaining money and absent on 28.02 13.I served him noticed for execution of contract twice but noticed return to lawyer with not claimed remark.After that he sent me letter on 25.07.13 stating that carry out sarkari mojani of field then only I am ready to execute the deed.I published the notice in local news paper to him to execute sale within 15 days .but he not respond and before completion of 3yrs to agreement he went to court for recovery of advance.there is no any term like sarkari mojani in sale agreement.where as the land measurements is done privately in his presence and with 2witnessed present while signing contract.what may be the result

A.Dear client there is need to review the clause incorporated in the the sale agreement for breach of contract. If in contract there is no forfeiture clause for breach of the contract, refund the amount and get the sale agreement cancelled.

A.Need to review the clause incorporated in the the sale agreement for breach of contract. If there is no forfeiture clause for breach of the contract, refund the amount and get the sale agreement cancelled. You can look around for some other buyers willing to buy your property

A.If your land is a revenue land a survey is not unreasonable, even if it is not mentioned in teh sale agreement.
