I am Ms.Savita, retired govt teacher.
My mother died in aug,1990 but my father didn't applied for the family pension but now i want that pension.So i just want a advice that it is legal or not ?

A.Dear client it's too late now. If your father is alive,then he is entitled to get family pension and he is also entitled to get arrears of family pension.there was chances if your father add some family member as a nominee then could be possible.try to go through experienced lawyer who handle this type of cases

A.Dear Madam,
You are entitled for pension as recently Supreme Court says it is not a charity but it is a necessity of the pensioner. If you share more details I can advise accordingly with supporting judgments. Probably you may need to approach High Court to get a direction to your employer.

A.Dear Madam,
Family Pension is allowed and entitled to either spouse .In case your mother was a Government employee and drawing pension either through Treasury or Nationalised Bank must have joint photo with the Nominee which is the standard procedure.Actually your Father is legally entitled to have the family Pension.Your first sentence states that you are a Retired Teacher which means you must be getting Pension.You can not have two Pensions in any circumstances.
However, your father can apply if he is alive and willing to accept the Pension and Pensioner benefits. I am in line with other Lnd Advocates.

A.Dear Client ,
you may take a chance to approach to H.C for the same but, This is too late, since your mother died in 1990, then Court may ask why you did not approach earlier, that means pension has not been worth for you.

A.Dear Client Your case is related to Pension Rules.
So First tell me
1 That in which department your mother was serving ?
2. In which State she was serving ?
3. Was she retired from service or died during the service ?
4. Has she filled nomination form? if yes then who were the nominated person ?
Answer these questions, and i will tell u what to do next.

Dear client my brother Lawyer Prabhakara S K Shetty has replied u ""Your father only can apply for it."
Dear client it is a correct answer. But now your father is not alive and u r married and self earning and the the matter is too old as of 1990 so u r not entitled for the family pension of your mother at such belated stage.
Do not waste your money in litigation.
