My friend who is married not happy with his wife so he came close to me and have physical relationship and also put sindur as per hindu rituals now i m also his wife but he denied can i file a case against him now he is saying i m his friend .
And his family members ruining my reputation in society

A.lodge a complaint with the local police station against u/s 376/493/494/496 IPC (false promise for marriage)
Section 493 in Indian Penal Code: Cohabitation caused by a man deceitfully inducing a belief of lawful marriage.—Every man who by deceit causes any woman who is not lawfully married to him to believe that she is lawfully married to him and to cohabit or have sexual intercourse with him in that belief, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Section 496. Marriage ceremony fraudulently gone through without lawful marriage.—Whoever, dishonestly or with a fraudulent intention, goes through the ceremony of being married, knowing that he is not thereby lawfully married, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
Section 494. Marrying again during lifetime of husband or wife.—Whoever, having a husband or wife living, marries in any case in which such marriage is void by reason of its taking place during the life of such husband or wife, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

A.Your marriage with him is not legal
You were aware that he is married

A.Dear Client, Putting sindur on to you , may not be said as marriage performed. Whether ur marriage had been done chanting mantra moving around Havan kund ie. Agni . Before any body . If does not happened so. Marriage can not be said legal. You must have proof.

A.U as per ur own statement had physical relationship with a man already married. He also put sindur but merely putting sindur does not amount to marriage. Even assuming it to be marriage, the same is void as the man is already married and has not taken divorce from his wife.However u are not without a remedy. U can file a complaint of rape on the promise of marriage. Beyond that u have no remedy. However, if somebody defames u, u can file a defamation suit as well as a criminal complaint for defamation.

A.In the first sentence you have stated that he is not happy with his wife, so he came to close to you and have physical relationship and also put sindur as per hindu rituals and you are confirming that you are his wife. How you will become his wife. Physical contact and putting sindur will bring you status of his wife. As per hindu marriage act there are some rituals to be performed like sacred fire, chanting of mantras, arranging of marriage by elders, not spouse living, and other rituals to be performed. You consult experts of hindu purohits what are the required rituals to be perfomed to become wife to hindu male. What you have stated are not to become to be wife as per hindu law. If you file any case it may not turn fruitful. So think twice. You have at best can file a case of cheating, that he cheated you from not marring you. When a person with spouse living how can you become his wife.

A.You do not become wife to someone by that friend putting sindhur on your forehead y except in Hindi Films. However, he would be in serious trouble if yuo are able to prove what you said here. Take a drat complaint from me to file in your area`s Courts.
