Dear sir/madam
I was married in the month of june 2018.. Second day after marriage my husband trapped my mobile without my knowledge... I used to send messages to my parents and also friends... I used to say abouft the negatives of my husband... There is also one friend to me who is boy... I used to chat with him as well....I donno wat sort of vulgar messages he had sent to my friend in the name of mine... he took printouts of all the messages and saying that i had an affair with him.... Moreover my friend is not in this country.... Can i file a case on him for his illegal activity of hacking mobile....

A.Dear Madam,
As per recent Supreme Court Judgment Section 497 is scrapped and he can do nothing against you.

Section 497 in The Indian Penal Code
497. Adultery.—Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such case the wife shall not be punishable as an abettor.

A.Dear client if you have clear proofs against your husband then try to settle your matter with discussion.i think your husband try to trap you and thinks about divorce.better way to consult and discuss with family member firstly.if they support you then you can take any action like legal of police.

A.Yes, you can always file a criminal complaint and also invoke provisions of The informationTechnology Act which are penal in nature.
