A.Facts not clear. Can you be more specific about your situation.

For your understanding
Section 145. Joining or continuing in unlawful assembly, knowing it has been commanded to disperse.—Whoever joins or continues in an unlawful assembly, knowing that such unlawful assembly has been commanded in the manner prescribed by law to disperse, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

I have a plot dispute between we and against party some days ago against party have gone in my plot with Constructions elements and labour then I trying to stop them and making a dispute moment fighting moment then police came and stop the construction work and stop both parties in plot and hardly instruct both parties not to go in this land till my reports submitted to SDM district Sahibganj Jharkhand then SDM will take decision in this matter. Some days later SDM send a notice both parties under IPC 144 has been put on both parties about this land and next preceding date is mentioned in this noticed . my questions is that when is du SDM converts IPC 144 into 145 because I consider SDM Sahibganj Jharkhand taking a selfish decision in this case against me. my against party are took SDM in own favour by high reference. Then we got very tuff troubled situations by this SDM work process. A another ipc 107 is continuing between both parties in same SDM court . Many inlegal order passed by this SDM against us . So I have no faith in this present SDM. I think this SDM convert ipc 144 into 145 against me.how I stop the SDM for doing this. Is ipc 144 can change in another magistrate court...?

Section 144 of the Criminal Procedure Code (CrPC) of 1973 empowers an executive magistrate to prohibit an assembly of more than four persons in an area. According to 141-149 of the Indian Penal Code (IPC), the maximum punishment for engaging in rioting is rigorous imprisonment for 3 years and/or fine.
a tehsildar is a tax Officer accompanied with Revenue inspectors. They are in charge of obtaining taxes from a tehsil with regard to Land Revenue. A Tahsildar also known as Executive Magistrate of the tehsil concerned.
Section 145 of the Code of...the civil proceedings having achieved finality, it appears that proceedings under Section 145 CrPC were initiated. You may also approach the High Court under Section 482 CrPC seeking quashing of the proceedings under Section 145 CrPC.
