I have filed private complaint in sub court and respondent filed a quash in high court.
Now hearing in subcourt will continue or only after finishing the quash case in high court hearing in sub court can be continue.

A.Dear Client, You have filed complaint case at court below, then there must have been some cognizance on it by court on your complaint, on which opp.party may have moved to high court, if that quash application be taken on board and some stay has been granted against ur complaint, then only ,the court below will stay. Otherwise court below has power to go on hearing , not stoping simply filing for quashing and informing court below and plea for stay.you may consult for needful

A.If the proceeding in the court below is stayed by the Hon'ble High Court then only hearing in the court below will not proceed, otherwise court below shall proceed with the matter.

A.there is no meaning of quashing your proceedings will be continued, if in the mean time if High Court feels and give instructions tosub courtthen only the proceeding will be quashed.. For details, contact some advocate through vidhikarya.com
