HR not allowing to leave company even after the acceptance of my resignation from my Seniors
the HR are asking to serve notice period of 30 days while I have serve notice period of 60 days
they are extending my last working days even after the acceptance of resignation

A.Dear Client
If your reporting manger has accepted the resignation and you have already served the notice period of 60 days as per the terms of the employment offer then what HR is doing is not legal and absolutely wring in its part.
In my opinion you can send the HR a legal notice for this act and seek an early relieve as possible.

Please note I have resigned on 06.01.2023 and ask my seniors to released me in 2 months even they agree and provide their confirmation on mails and on the HRMS portal but the HR and CFO pressured me to serve full 3 months notice their is no option of buyout as per the SVP HR as of my last working day is 05.04.2023 but I join the new company on 03.04.2023 as they cant extend further The HR called me and said as you have not serve the notice period the CFO of the ex company has ask to hold the FNF and reliving letter I have submitted all my belongings to the company on 31.03.2023 as it my HOD as agreed to relieve me by 31.03.2023 on mail but CFO is not agreeing on this and telling me ready for the consequence

A.Hello Client,

In such circumstances, you must send a legal notice to your HR and the company stating the same with the assistance of an advocate.

A.Hello sir,
There is no way that the company can force you to serve the full notice period. The clause in the employment agreement usually states "ninety days' written notice or three (3) months gross salary in lieu thereof". Therefore if you are willing to pay, the company should not raise any objections.
