4 months salary not paid

Dear sir, my 4 month salary is due in my previous company. I leff the company as it was not able to pay the salary regularly and also in time. It was a private limited company. I was given a joining letter in which employer had to give one month notice and employee had to give three months notice. My salary was in excess of 50,000 p.m.
Can I approach labor cort?
Can I get relief under Payment of of wages Act 1936?
Can I approach Labor Commissioner under section 12 of ID Act?
Please tell me the most apt provisions of law under which I can see the payment of my pending salary from my previous employer.
Also during my 16 months of employment company deducted the TDS but did not deposit to the government. How can I use this activity of the company to pressurise them for speedy recovery of my salad use?
Please bring this to the notice of the Labour Commissioner and Income Tax Authorities.

You can file a civil suit aginst the company to recover your money. Before filing a case you can send them a legal notice.
