Hi sir,
My husband is having so many affairs. He is not interested on me either in family life or in physical life. He tried som any times for divorce but ibrefused to give. Now he left the house and living separately. I am having 10 years daughter. I need my husband back. How can i take him back by legaly saying to him. Please help me

A.Dear client.. file RCR ( restitution of conjugal rights)and along with maintenance case against Ur husband... immediately in family court..to take Ur husband back.. and get u and Ur daughter's maintenance.

Thanku mam for your response. But he is not willing to stay with me he is forcing me to give divorce but i refused i need my husband back for my daughters life. Whrn i told that i put case means he told that police take bribes and do not put vase on me.i am dependent. My father is expired i have my old mother only. So many times i begged him to leave illegal affaits as daughter is growing but he is not listening and continuing same.

I understand Ur concern Mam . First u lodge a police complaint.. against Ur husband and his GF...if they will give bribe also No worries..u will have the proof of lodging police complaint in record...then u can file DV case..( Domastic violence) and claim maintenance from Ur husband..if u r from Bangalore..pl contact me.

A.Dear Madam,
First try to ascertain if your husband is married to somebody else.
If it is the case then file a Case under 494 IPC for bigamy.
Next step is file a case in the family Court for maintenance of self and 10 year old girl .
Next step would be to file another case U/S 9 of HMA for restitution of conjugal rights.

Hi sir,
He did not marry anyone else. But having affairs . My daughter is asking her father to come back. He is giving maintainence.
But he is not interested to come back. I have warned his girl friends so many times but they taken my words easily.
Everyone in our apartments are asking abt my husband where he has gone living u and ur child. What to do sir. We need protection .

A.Hello Madam,

Legally you can file restitution of conjugal rights petition in the family court where you or your husband resides or where you both last lived together or where the marriage happened, with the help of a local lawyer after understanding about the pros and con of this case.

A.Dear Madam,
Your husband is not an object which you will get legally.
Now coming to your point if he is having affairs with so many then ask him to stop or if you want to stay with him with that habit you have to tolerate.
If he is not staying with you means he is looking for other options.
Under the circumstances, file a case for divorce so that both of you can have your own life.
So far Divorce is concerned if you can have divorce with mutual consent then your problem can be solved within 6 months.

What about the future of my daughter. My husband dint give single rupee in mutual understanding. He wants me to go to my parents house. I have only my mother. She is too old. A.Dear Ms Bhanu,
You have a number of legal remedies available to get rid of this kind of critical situation. You should immediately lodge a complaint before the concerned police officials u/s 494 of IPC i.e. for bigamy, if your husband has married to some other lady. Meanwhile, you can file a petition u/s 125 of CrPC, if he is not even giving you the maintenance. You can file a case of domestic violence as per the provisions of PWDV Act. You can file a case u/s 9 of the HMA for the restitution of conjugal rights, if you want to live with him. On the other hand, you can also file a divorce petition u/s 13 (1) of the HMA, if you don't want to live with him. For more information, you should contact a good legal practitioner from the Vidhikarya platform having specialisation in family matters.

Dear Ms Bhanu,
First of all, you should ask him strongly and firmly that you are not going to divorce him and if he is in need of divorce, the doors of the court are always open for him, from where he can obtain divorce as and when required by him. Secondly, it is your right to reside with your husband because you are his legally married wife. Hence, you should trace out the current residence of your husband and should start to live with him forcefully. Thirdly, you can lodge a complaint for domestic violence against him. Fourthly, you can file a petition u/s 9 of the HMA for the restitution of conjugal rights, but if you are going to opt this method, you shouldn't start to live with your husband.
