A.Dear Client,
If your mother is unable to maintain herself and she files a case against her sons under sec 125 CRPC or under sec 5 of The maintenance and welfare of parents and senior citizens act , you and your elder brother is liable to provide her maintenance but if it can be proven before the court that she is able to maintain herself or you and your elder brother is already providing her enough maintenance then you or your brother wont be asked by the court to provide her maintenance .

A.Sir, as per law maintenance can be claimed by the parents [if they are unable to maintain themselves] they can claim it from their children. They can also claim it under various acts of India. Examples are 125CrPC and Senior Citizens Act [provided your parent is 60 or above 60]. The only way to opt out from paying maintenance is that you need to show that your parents have reasonable income to take care of themselves and that you need not pay any amount to them.
