Myself Pravin David and I am married since 16th May 2008 under special marriage act. But now I want to take divorce with my wife as things are not getting smooth and lot of compatibility issues. We have a 1.5 year baby boy. And we have been living separately since last 7 months.
Kindly let me know how and when can I file divorce case. We got married in Purulia, West Bengal and currently I am living in Haridwar, Uttarakhand

A.Dear Sir,
It is better to go for mutual divorce instead of contested divorce. Before that get issue a legal notice and have her idea about divorce and alimony.

A.Dear Send one a legal notice write down,about divorce,and family settlement like child,maintenance, how property will settle,
You can go with mutual divorce if she agree with you,Or Contest divorce she agree in court

A.First u should file RCR petition then divorce petition if Ur wife not ready to return Ur home then only
