IT sent a notice that in 2007 a company was registered with ROC and the company has not filed taxes in assessment yr 2011-12. The company shows 2 directors and one of them is my father (now age 77). On internet it you search it shows as company had capital of 1lakh. My father does not remember starting such company, investing money in it or getting any money from the company. .
1) Is it legal to send notice after 5 years
2) How to respond to 148 notice sent by office of rank Ward Income Tax officer
3) Assuming such company was started in March 2007 and my father was directly involved with the company which is only registered and seems to have done no business , how does e respond to notice?

A. The problem stated by you is complex in nature.
Firstly ROC does not register the name of a director just like that. It takes in to consideration many factors.
There are a lot of formalities which have to be complied with in order to get registered as a Director.
The answer to your queries are:
1. Yes.
2. You have to reply as per the notice received.
3. The response would depend on the notice received.
You may consult with proper documents for professional advice.

A. Your father age or legal notice after 5 rears are not issues. The issues are was he Director & in the record of company his name is still in existence. You have to respond to the notice. It is better to consult a Lawyer who will guide & help you to a logical end to all issues.

A. Sir,
The Govt presumed that it is a "Shell company" and you replay the notice through the tax advocate.
