DEAR TEAM,
AS WE ARE ONE BROTHER AND TWO MARRIED SISTERS. ONE IS ELDER & ONE IS YOUNGER. THERE ARE ONE PROPERTY IN THE NAME OF MY MOTHER WHOSE DIED ON 02.07.2017. MY FATHER DIED ON 17.06.1997.
THERE ARE NO WILL MADE. KINDLY ADVICE ABOUT THE FOLLOWING QUERIES:-
1). FIRSTLY, MY QUESTION IS THAT AS PER LAW THERE ARE THE QUESTION RAISE ABOUT THE PROPERTY DISTRIBUTION OR NOT AS MY
FATHER DIED ON 17.06.1997.
2). IF THE EQUAL RIGHT LAW RAISE THAT WHAT WILL BE THE SOLUTION OF MY QUERY.
KINDLY ADVICE ME ABOUT THESE ISSUES.

A.According to supreme court decision in 2018,all the daughters and sons of deceased parent will have equal share right over the property of deceased father or mother.Supreme clarified that sons and daughters born before 1950 will have equal share right.by birth

A.Yes all the members of the family will get equal shares. It is better to consult a property Lawyer to verify the document and to secure the title of the property and sharing the property.

I want to clarify that as per supreme Court decision the equal rights law came in Sept 2015 and my father died in 1997. So its equal distribution law will not apply. So kindly check these query at your end
