About 498a case file

I am Dipa Mukherjee age is 59+ and my Brother in-law Arun Mukherjee continuously mentally and economically harassing me and my husband. My husband is a Senior citizen and seriously ill almost bedridden. My Brother in-law Arun Mukherjee taking that advantage. Previously he filed a false case against my husband and submit a false deed. We won that case 2017. Now we decided to give our house for promoting and Arun Mukherjee had taken Rs. 50,000 from promoters and he with that promoters together threatening us and blackmailing us. Gave us layer letter claiming Rs. 5 lack. Can I filled a 498a case against Arun Mukherjee for this kind of harassment. Is there any age limit for filling this case? If I can't fill this case then how can I go further to fight against my brother in-law?

You may file FIR and Complaint case against him. If he is residing jointly with you then a Domestic violence case may be filed.
If he has withdraw ₹50000/- without your permission from promoters then ask all about how promoters allowed to give him such money. Make a clear deed / agreement with promoters with rights and benefits, if ur Bro. In Law is shre holder then clearly specify not without ur permission for any payment.
If promoters defrauded with you or breach you file FIR u/s 420 and 120 , 467, 468 of IPC.

You may approach Assistant Commissioner of Revenue under the provisions of Senior Citizens Act through your husband and get immediate relief.

What are the important features of the Maintenance and Welfare of Parents and Senior Citizens Act 2007?
Ans. The Maintenance and Welfare of Parents and Senior Citizens Act 2007 envisages providing need based maintenance to the parents/grand parents from their children. Tribunals will be set up for the purpose of settling the maintenance claims of the parents in a time bound manner. Lawyers are barred from participating in the proceedings of the Tribunals at any stage.
The Maintenance and Welfare of Parents and Senior Citizens Act 2007 also contains enabling provisions like protection of life and property of senior citizens, better medical facilities, setting up of old age homes in every district, etc.
What is the applicability of the Act?
Ans. The Act extends to the whole of India except the State of Jammu and Kashmir and it applies also to citizens of India outside India (Section 1(2)).
When will the Act come into force in the States?
Ans. The Act come into force in a State on such date as the State Government may, by notification in the Official Gazette, appoint (Section 1(3)).
