icon Property ownership

Hi, I stay in a flat from 16 years. This flat is in my aunt's and grandmother name. Grandmother has 2 daughters and 4 sons. Total 5 children of my grandmother. Two of son's are expired and I am his son

A. No. Since flat is in joint name of grandmother and aunt hence on death of grandmother half portion of flat is liable to be distributed among all legal legal heirs of your grandmother i.e. her daughter's and sons in equal proportion including your mother but only being gradson you donot have any independent ownership right or title over the flat. Your stay in flat is merely as permitted licencee only. Payment of bills etc does not constitute any ownership right in your favour.

Husband is a retired central government employee. Does his wife gets half of his pension if they got divorced.

A. The amount of maintenance depend upon earning of parties ,their status etc so if wife does not have independent income or does not have sufficient income to be able to maintain herself then court should consider total earning of husband from all sources be it pension, fixed deposits, rental income if any etc and can award upto 50% if total income if husbabd as maintenance to wife.

The year of such sale has not been specified herein and when you and your sister have attained 18 years o ...ReadMore

A. When that property was purchased in registered manner in the name of your sister and as she was minor then ,that's why her mother as her guardian executed that registered Purchase Deed on behalf of that minor daughter, then you cannot attach that property for Partition purpose. That Property is the exclusive property of that sister and her other siblings have no right to that property.

A. It is necessary to know whether your father is alive or not and whether that Will is registered or not. It is also necessary to know that whether your father has given his Will to your brother or not. To give opinion on this issue the aforesaid facts are necessarily to be disclosed because Will is a confidential document and usually the Testator prefers to keep it in secret.
