I went on maternity leave o. 19th March 2018 and notified about my leave till 4th Oct to HR and reported on 5th Oct.. they sent a n email on 11th September asking to join on 17th sep.as 26 weeks completed on 16th September. I replied to that email that I applied for leave till 4th Oct and hence I am reporting on 5th Oct ... When I reported on 5th they first tried to tell me that I have reported late and hence should serve .A notice period.of 3 months and then leave ..Later on towards evening they started exchanging emails on termination without any discussion with me and by 8th Oct a termination letter was sent to me ... I tried speaking to CEO on this matter , sent him an email as well but he did not respond till.date .. I also write to board members on the issue 2 days back and even they have not replied till date. How should I go about making them withdraw this termination ? I did take additional.leaves but it was informed to them in the beginning itself and again on 11th September..They never corrected me on the date sin the beginning and now making it a big issue and a reason for termination.

A. Mam, Firstly, I will suggest you to keep mailing them regarding this issue as this is the proof that can be used if you choose to take them to court and file a case against them. secondly, I want to know on what basis were u employed? Because if it is on contractual basis them there has to be a clause of maternity leaves and then by Maternity (amended) Act, 2017, you can sue them or file a Writ against them for reinstatement and compensation. Please consult a lawyer ASAP to take an appropriate action before your final termination.

Dear All respected adviser's I have given resign to the company where I was working and the gave me salary cheque but payment of cheque has been stopped by employer and check got returned now employer is asking to return back old cheque and then they will do rtgs but I am sure they will not give any money so pls advise what to do now

A. Sir, You can first write to them and then if they don't respond then send them a legal notice for recovery of your salary.

How can I get divorce after separate from 5 years? I have 3 children and I am living sepratally from 6 years because of mental torchar he force me to abortion for 4 times because of girl now I want to divorce plz help me I don't want money I need only divorce how much it will take time plz I don't want to any relationship with him.

A. Mam, You can file a divorce petition in the court through some advocate as well as Domestic Violence as you have appropriate ground to file it.

Hi I have filed a divorce case against my wife.we have a simple marrige and no dowry has been accepted by us.But after divorce filling they filed an fir for 498a,323,377,354,511 against me and my family.Please help

A. Sir, Firstly, Apply for an Anticipatory Bail for yourself and your family. You can file a complaint in nearby police station that she was blackmailing you. Secondly, the dowry case is the repercussion of that Divorce Petition filed by you. You did right by filing divorce first because now you have upper hand in the case as the FIR would be seen like a counterclaim by your wife which you can plea before the magistrate. Thirdly, make your case strong in the divorce petition filed by you or else try to settle the matter. If the matter gets settle then you can go for quashing of FIRs. And you can ask your advocate to file a counterclaim against her dowry case and collect all the evidence against her i.e. the call recordings or CCTV footage etc. If you do not have an advocate then you can consult Vidhikarya to provide you an advocate.

My house is under construction for which building material is kept in front of my main gate outside the campus. On the basis of a fake complaint some person from municipality visited my house and forcefully asked to remove the building material within 24 hrs. I told them its in front of my campus and construction is going on but they didnt given any notice in written and asked to remove forcefully in 24 hrs. Pls suggest what to do as it is not possible to remove within 24 hrs . They threatened to seize the material without any notice

A. Sir, no government official can seize any material without giving prior notice. Do not get affected by them but just don' t create any difficulty for others to live with that building material.

A. Sir, First thing When did you file the matter? and What stage is it? As of now what you can do is ask your advocate to move the matter quickly and if some long date is given then ask him/her to move an application of early hearing and proceed with the matter.

Dear Sir My wife has psychological problem. She some time getting violent due to her mental imbalance. We try our level best to cure her but we are becoming failure. I have a 10 month old baby boy. I want to know if divorce will happen who will get custody of child.

A. Generally, the custody goes to the mother of such a small kid but in your case, if you prove that your wife is mentally unstable then the court will give you the custody.

I got married six months back. On the night of my wedding my wife revealed to me that she s not intereated in marraige life and was forced by her parents to marry me. A. Sir, you did right by filing a complaint in the Police Station as further if your wife comes back and claims anything from you or put any false accusation then you have a proof that she ran away. Now coming to your marriage then sir it is a valid marriage even if it is a one day marriage and unconsummated. You can file a divorce either mutual by taking your wife into confidence or contested if she doesn't agree to give you divorce.

Dear sir /mam, I have passed in a govt of Jaipur vidhut nigam ltd that govt psu. A writ filed against recruitment and stay imposted of 14 days with reply and date of listing was 17sept 2018. On 17sept 2018 due to advocate strike new date relase 26 sept 2018 and case status is showing Fresh admission without stay. What is it mean? Whether stay vacated or not?

A. On the date of hearing i.e. 17th September 2018, the order should have been recorded as "Interim orders to be continued". Please check the order. If that is not the case then you have to wait till next date of hearing.
