After our arranged marriage, after ten days he went to Canada and stopped contacting me. His father started torturing me mentally and his mother supported him. He wants me to stay with him 1st and follow his commands then he will decide he will send me in Canada or not. I want to deport him from Canada and took steps against them. How can I take action against them?

A. file a case of Domestic violence against your in laws and also husband.

my husband they are 4 children’s 2girls and 2 boys.after fathers death mother and one sister taken care by sons. Now my husband sisters and her husband they are staying our house . They are not allowing us to enter the house my husband and his brother and both wife’s. We made domestic violence case . We have all the proofs from inlows house For the property sake these are inside our house and misusing the women’s right. So plz advice me we don’t have any house rather than husband house.my sister in low have husband house nobody is staying in that house . Property case is going on in court still they are missing court cases . So plz give me solutions.

A. if the property is self acquired by your father in law or if it is ancestral property file a partition suit for claim of the property.

Sir/madam As mother gifted for auto to his son for his business purpose.. Even they made an agreement bond for the above auto expanses to son and mother. Now son passed away. As the case son wife took auto as it's her husband property. Now mother asking as it's gifted now need to close her loan amount.. What steps need to be taken care

A. Any property or item once gifted cannot be asked to be returned back.

A. There is nothing here to be adopted legally. Your present husband is the father of your son from 1st marriage. Change the name of the father in all the documents of your son.

I got 3,00,000 INR as a gift from my mother via bank transfer for immigration purpose and preparing a GIFT DEED for the same. I have got the format online and going to print it in a stamp paper and get that signed by me and my mother in front of two witness. My questions are 1. Is registration of the GIFT DEED mandatory? 2. What should be the value of stamp paper? 3. Anything else that I should consider? Thanks in advance!

A. in cases of bank transfer you may or may not go for gift deed. But, in case some of your other family members accuse you for coercion or fraud in such case registration is better. In case of Mother gifting to son the rate of registration and stamp duty is very nominal and there is no boundation in regards to value of stamp paper. You can use stamp paper from Rs.10 to Rs.5000 depending upon your choice or stamp duty as specified by registration office.

Purchased a flat under HUDA affordable from Builder Pyramid Infratech in sector 70a, Gurgaon. Made payment as below:- Feb,28,2015---Amount Paid==107500--service tax--3.09%==3263 Sep,12,2015---Amount Paid==439052.45--service tax--3.50%==14786 March,05,2016---Amount Paid==273174.55 August,27,2016--Amount Paid==309909 Total Vat charged @5.25%from Feb,28,2015 till Sep,15,2016==55447 1 question--Is service Tax payable? If not how to get it back 2 question--Your charges including all paperwork

A. The time you purchased the Flat during that time service tax was payable. GST came in the year 2017. Therefore, you cannot claim such from the builder. But, if the builder charges you service tax extra upon GST on and after 1st july 2017 in that case it is illegal. And you can only claim refund of service tax only on that time.

I want to divorce my wife. She mentally tortures me and has extra marital affairs. She ownes the house and has a govt job. She convinced me to quit my job as I was too young. Now if I go for work, she stops giving food and locks the door. My parents are of no help as they want me to stay with her inspite of knowing everything. I can't afford a lawyer. Is annulment possible? I was 20 at the time of marriage in 2003. I can't wait for a long precedure as I m exhausted mentally and financially.

A. court procedures depends on what accusations you make and what evidence you bring to affirm those accusations you make before the court. Moreover, the opposite party lawyer will not sit idle and listen to you about what accusations you make and what evidence you bring. You will be countered on each and every step you make. Justice can only be served when both the parties are heard and everything is properly justified therefore, court procedures are a bit lengthy. If your wife gives you divorce mutually in that case it can get over in 6 months, But, for divorce contested you need to be patient as it will take time. If you are exhausted financially then District Legal Aid Service is there for you.

Hello Legal Experts, My cousin was influenced to sign the mutual divorce petition and her husband though he is willing to continue the marital ties was influenced by his family to sign the mcd petition. the first motion is done and the second motion is posted for 5 months from now. However, she would like to save her marriage and wants to file a unilateral withdrawal application before the family court stating that she wants to save the marriage. Can she file an affidavit in advance to withdraw her consent given earlier to MCD? IF yes, what is the procedure. Since the case is pending in the family court in the boy's native,the boy's father might try and influence any one to get this divorce through, hence the girl wants to take all the precautions and wants to pray before the judge to dismiss the case. There was no benefits(monetary or other benefits) during the signing of the first motion The boy lives aboard and will be here only during second motion. Can my cousin file the withdrawal affidavit and refrain from appearing before the court on the day of second motion? also can she request for in-chamber hearing with the honorable judge family court at the time of hearing Your legal opinion will help save a marriage!

A. You can withdraw the case jointly on any day. You need to PUT UP the matter if your case is not enlisted during that particular day. Or, you can withdraw the case on the next date you have been enlisted for hearing.

the property has disputed into 5parts the persons given registered cheque.the cheque has bounced can i get justice in this matter

A. Yes you can opt for cheque bounce or money suit. Also you can revoke such distribution unless the dues not paid.

My daughter inlaw died of cancers she had two daughters Who will be entitled legally to her property. Daughter or her mother

A. After marriage of a girl she is considered to be the family member or part and parcel of the family where she is married. Moreover, when a married woman dies intestate her properties gets devolved upon her husband and her children if they are alive. So, her mother is not entitled to receive any portion of the property.
