My husband is not ready to get separated. But I don't want to leave with him. He is alcoholic and his behaviour is not good towards me. If I ask for a divorce he says will not leave u. Make sure you will suffer whole life if you leave me.

A. When one of the spouses are not willing to give divorce when the other wants it, as Law Courts are in favour of saving marriage. What you are suggesting is cruelty from your husband towards you. So, first you collect some proof-evidence for his cruelty. I do not know if you are with him, or left him.

Hello Sir/madam I am a retired bank employee I got retirement in Aug 2016. I didn't opt for pension initially as my bank (Bank Of India) was asking for some funds for availing pension. As I was little short on funds at that time I didn't avail pension but now i have funds and I am willing to give it to bank and get my pension started. Recently bank proposed an offer to avail pension for retired bank employee in exchange of funds but it turned out that it was for those employees who were suspended. I am advised that I can avail pension as it's my legal right ......i want a professional opinion in this matter that what kind of legal procedure should I follow to get my pension started.....approximately how much time will the procedure take and how much will it cost me

I am a woman staying alone in a different city seperate from my husband for the past 1.5 years though we are officially not divorced as he refuses to divorce me. But I have no physical contacts or any financial dependency with my husband. I texted him but he doesn't bother to reply.. Am I still in his nikah?? He has taken back my Mahar before he removed me from home. All gifts like bike furniture everything is with him only.. Now I want to marry another man, do I need an official divorce from my first husband ?? How can I send him a khula ?? Please guide and help.

I have two children both are below 10 years. I already applied divorce. Now my children are with his father. I have some property which is inherited from my forefathers can I sell them for my needs.

My relative filed fake rape case on me at that time I was in Mumbai. Even though I was not their my village. How to get rid of this case

My marriage was on first week of Feb 2018 She left me in first week of march without registration of marriage Last week of April we signed divorce agreement on 100 Rs stamp paper I found information that thus agreement is not valid. Now she marry to other person. Can I file bigamy against her? If yes then How can I prove my marriage without registration certificate of my marriage I have her second marriage certificate copy. My marriage was arranged marriage.

My husband is habitual of doing frauds of money. We are married for last 10 years. I have been observing this habit of 420 kind of things since marriage. He has fulfilled no responsibility for me and children. Though we are living together but our image in neighborhood, relatives and at other places is going down. I have made him understood many times to leave this habit and lead a simple life. We both are working but he always depends on me for even petty expenses of family. The financial management of my family is really poor despite we earn good. He always creates problems and leaves upto me when it comes time of payment. Due to which I m getting fail ed to save money for my children future. Earlier I though that may be things would come on track with the passage of time. But as such no change has come. This is also because my both father and mother in law are also of the same nature. All are very greedy of money. I don' t understand what to do? Should I take initiate for divorce or let it go? My own parents never supported me. Because of this they have also taken their steps back and left upto me. Plz give advice.

A. If besides all that you have narrated about him if he is also not useful to family financially, you can file for judicial separation from him.

My cousins wife file complaint against me. I am live in thane with my family. and our family is sepearted. One issue happened at the time of Ganesh Festival. His brother came in my villege and fight with my uncle that i did the stop fighting both. but cousin's wife file compliant against me also. Can i file complaint against her.

A. What would be your complaint against her ? If she has not done any criminal act against you, no complaining against her. You should defend yourself.

I want to challenge the gazette in which my property was listed as wakf property. which court I should approach, high court or ap wakf tribunal

A. Issue a notice to Wakf Board, File a declaration suit in civil Court. Just because the board printed a list Wakf Board does not get jurisdiction over the matter.

Ordered an adult toy for someone who has been single since a long time. The object depicts an artificial female private part. Facts of the case: 1. At time of ordering, I did not know the law around purchase and import of adult toys. Although I was ordering for a friend, I was smart to misspell my first name. 2. The item has been held by customs today so I am expecting a show cause notice. But, yesterday itself, I submitted cancellation request to the seller in writing on their website and took screenshots. Both, of the tracking on India Post and the website showing my cancelling request in writing. 3. I no longer want the item after the law is clear. Don’t want a person hearing. Ready to pay the fine and let go of the item. Please share a draft reply to such an SCN. It will help a lot of people around the Internet.

A. Ordering an item is not a crime. If customs officials confiscate it, let it go. They cannot do anything to you.
