the property has disputed into 5parts the persons given registered cheque.the cheque has bounced can i get justice in this matter

A. Yes, you can get justice. Firstly, issue a statutory demand notice to him (the drawer of the cheque) under section 138 of the Negotiable Instruments Act demanding/specifying the cheque amount "within 15 days" of receipt of the notice. Failing any receipt of the cheque amount, you need to file criminal case under the same law in the Court of Magistrates Court for prosecution of the drawer for offence committed under the said Act. Contact any local Advocate from this portal, for territorial jurisdiction etc. File the complaint in Court within 30 days, after the expiry of the said "15 days" time granted in the statutory demand notice. This is for criminal prosecution. Later on, within 3 years from the date of cheque, also file a civil summary suit for recovery of the amount. This is civil recovery proceedings.

Hello Sir/Madam, My Wife mother Expired 4 years back before our marriage. He father had registered 8 acres of land in her name( But the matter is this property is already in court as my Wife's fathers sister had claimed right on it as it is ancestral property). So now lower court has given judgement that the registration is not valid and all his sisters have equal right in it. My Wife's father wisely before marriage has taken her to registration office and registered a document falsely stating that my wife has no claim in any of her father property has he is giving 30 lakhs as settlement and registered it( He has cheated my wife stating that for some sale purpose she has to sign in register office and also not given a single penny to her). Her brother has signed the witness. I believe this registration done that my wife has no claim in her father's ancestral property is not valid, As per Indian law both son and daughter have equal share in it . Could you please advise whether the false registration done by her father is valid? And how to proceed further.

There are two sons and two daughters of a married widow. She wills to give all her husbands property (which is in her name) only to her younger son as her two daughters are married and her elder son is currently staying apart from them and totally not taking care of the mother and his younger brother. Can she transfer all her husbands property (which is in her name) to only her younger son's name.?

A. No. Widow mother cannot give her husband's property to her one son to the exclusion of other son even if the other son is not taking care of her. She is required to divide it equally among all children. If daughters are not interested in that property, then the property is to be divided between all the sons. However, daugthers' signatures will be required on partition deed.

I got married in hyderabad in 2008 through Arya samaj and it was a love marriage against family and the marriage was not court registered after 1 year I got to know that she is a character less women having illegal physical relationships with different mens and when i console her abt this y u have cheated betrayed me then she said that from early days she used to do this and but even after this i forgive her and given a chance to correct herself but she didn't and doing the same again and we have a kid of 7 years and unfortunately I was met with an accident in 2014 and i had a serious head injury due to which my body got paralyzed and im on bed completely and even after this she didn't even came to care see me and later she said she will keep kid custody with her life long and now from 2014 to till date we have no relationship and living separately and she had all arya samaj marriage certificate and photos with her Please advice can I get marry with another marriage

A. You need to file suit for decree of divorce. Go for mutual consent divorce if she agrees.

My wife filed a case against me, after living separately for 11years.She is doing a private job with 1.5 lacs/month salary. She filed for divorce and one time settlement. I attended the court in the first summon. Since then I was never summoned or informed about the court proceedings or dates or even about the final judgment/decree.Now I received a summon after one year, as to why I didn't pay the sum of 10 lacs as ordered by court .

A. It means that though you had accepted summons and attended the first date of hearing but it appears that you did not file your written statement, nor contested the suit. You need to get a copy of the decree from the court and if you wish challenge it before Hon'ble High Court. Contact any local Advocate from this portal.

I'm married for 8yrs and mine is inter religion marriage and was in a joint family with in laws . Now my sister in law got married and my brother in law ran away since his business went in loss and because of these 2 people my husband was into a debt of 15 lakhs and he closed that after working in abroad for 3 yrs and now he is back. In these 3 yrs I was taking care of my 3 kids, his mother and I was working too. My father in law is not with us because of his bad behaviour and a complaint also registered against him in bangalore by me. Now the problem is my husband don't like me and he find mistake in all the things I do and he us very caring about his mother but he is always yelling at kids and me. I want to be away from him. Let him take care of his mother and I 'll look after my kids. I just want him to free meand my kids and let us live. What needs to be done .

A. Discuss with him and explain to him your difficulties. Suggest that you stay with kids separately for some time, maybe in a nearby location. If everything fails, then suggest for mutual consent divorce, and if he does not agree, go for divorce on ground cruelty and other grounds based on your experience.

I have 5 uncles,My father has beend expired and i want to sell the property we all r agree to sell property but my 1 uncle is refusing can i sell the property with my 3uncles after leaving the part of the property of my 1 uncle....

A. If one of your uncles refuses to sell or give his consent to sell, then file partition suit in respect of all ancestral properties.

Dear Sir, I have wife and 8 months daughter. Our marital relationship crossed 1year and 6 months.Between these period many times clash and argument happened between us. My wife always threatened to do suicide through knife, or other means. Later she and her family is threatening to file harassment case against us. I am thoughtless to what to do in this case. In future she and her family can file harassment case against me and my other family member. To save my other family member I separated myself from my parents and living with wife. Is there any means or precautionary measure to save myself and my family in future if this false allegation will appear.

My husband left us before 20 days. He has blocked my credit card too and he doesn’t give me cash. I survived 20 days by taking money from parents. Now all payments are due. He has blocked my no. What should I do.

A. Have it resolved mutually with well wishers from both sides and parents, and if it fails, go legally file police complaint, DV case and for maintenance.
