According to law is it compulaary to stay with inlaws
Share this questionShare Icon

A. Dear Client, It is not compulsory to stay with your in-laws. You are free to stay with your husband separately but your husband has to maintain them if they are not able to maintain themselves and that is compulsory according to law. Thanks.

If my husband do not give money to me and for my children .he has extra marital affairs. Whenever I ask for money he threathens to kill me and my children. Plz suggest

A. Dear Client, Lodge a complaint at the nearby police station for the mental agony that is being caused to you by your husband and thereafter you can file a suit under sec 498a which is domestic violence and along with it, you can also claim maintenance under sec125 crpc for yourself and your children.

This is prashanth-24 and my partner is 26 And she is married she is my ex and she have 2kids...now she is not with her husband since 2years she don't like him.and she did not have divorce till now. He is also not responsible person.... And if we stay in hotel is legal r what.. how to handle if police ride. And I am not married
Share this questionShare Icon

A. Dear Client, The police cannot arrest you unless and until you are doing something illegal and adultery has been decriminalized since 2018. So you can stay with your partner in a hotel room but as she is somebody's wife and also having kids , you both should give a second thought. It is morally wrong.

What should I do..

A. Lodge a FIR as soon as possible and then send a legal notice to the transport company telling them to repay such amount and your bike within a stipulated time period, failing which you will take legal actions against them.

My mother wants maintenance from two of her son(me and my elder brother). Please guide in this regard.

A. Dear Client, If your mother is unable to maintain herself and she files a case against her sons under sec 125 CRPC or under sec 5 of The maintenance and welfare of parents and senior citizens act , you and your elder brother is liable to provide her maintenance but if it can be proven before the court that she is able to maintain herself or you and your elder brother is already providing her enough maintenance then you or your brother wont be asked by the court to provide her maintenance .

A. Dear Client, If you want to get a divorce then do share this with your wife, if she agrees to it then file a divorce petition on mutual consent and if she doesn't then consult a lawyer through Vidhikarya and file a divorce petition on the grounds of cruelty.

A. Dear Client, you can file a divorce and on the grounds of cruelty if the action of your husband is causing you mental agony. After the divorce , you can surely go ahead with the girl you are in love with but as you have a child , think twice before you act.
