I am a divorced female..want to marry an unmarried who is younger to me..we both want to get married.. my parents are not accepting as he is from sc background..we want to get married legally..can I know the procedure

A. Dear Madam. There is no problem in getting married when both of you are majors and when you have court decree for divorce. You can approach the Registrar office for Marriage and they will do the needful.

My neighbour has set a CCTV camera facing the stairs an d my kitchen window and main door. He did not inform us regarding this. It makes me feel that somebody is watching us everytime. Also we are not sure whether it has a voice recorder. Is it legal to install a voice recorder.

A. It is a violation of privacy especially when it faces your kitchen window and main door.At first discuss the issue with them. otherwise we have to make complaint only

Hi My husband had filled a petition of judicial seperation section 10 of hindu marriage based on cruelty as mentioned in summon. I am living with him at his home with having a baby girl of 1 year. I don't want to give divorce or seperation to him. So Is this easy for him to get seperation through court.?? Also wants tò know that separation and divorce are similar ??

A. Divorce and separation are different.In divorce, husband and wife relationship comes to an end.In separation, the legal relationship continues, only thing is that they are not bound to cohabit with each other.During the period of separation,the parties cannot remarry.There is a scope for reconciliation and settlement in separation whereas in divorce there is no scope.

My husband took around 7 lack loans from different banks on my name and he is not paying that emi.The bank people asking to pay all debts.Now he is herrasing me and trying to give divorce.how to solve this issue legally please give sujjestion

A. when you don' t have any source of income, taking loan under your name and not repaying it amounts to cruelty under the Hindu Marriage act and Domestic violence act.You can submit a petition to the protection officer and seek necessary relief.

Sir i have sold goods to a customer in invoice.He issued a cheque against purchase.The date mentioned on cheque was 08.04.2018. but i presented the cheque in bank on 28.05.2018 and cheque bounced on same day.Today date is 05.08.18.Can i file a cheque bounce case against him?

A. You must have issued a demand notice to your customer for making payment within a period of 30 days of the receipt of information from the Bank.Otherwise you cannot file a cheque bounce case.

I have two married sisters. Both got married before the death of my parents. My parents expired in March 2005. My question is that do my sisters have any claim on the property which is still in my mother's name ? How can I get the property transferred in my name ?

My father was misdiagnosed by doctors and they giving wrong treatment.due to that treatment my father suffers lot of pain and nearly was on the step of death.actually my father was suffering from cancer but doctors giving them treatment of TB.we go to the other doctor they told us that there was gap in my father back bone. Both doctors giving us lot of medicine but my father has been critical.But when we were visit to mumbai doctor they provide correct treatment and they did cemotherophy on him and now my father is recovering.so now i want your legal advise for taking an action against the doctors.kindly suggest.i have all bills and report of doctors.i am left my collage due to this reason.plzzz suggest and advise me.

A. First file a police complaint and also make a complaint to the medical council of your state.If the police refuse to register FIR for any reason, then make a private complaint with the Magistrate under section 200 of Criminal Procedure code.Also we can approach consumer forum for getting monetary compensation.

Dear Sir: We are in the process of selling our property since the past 2 years. My father and mother (Age 79 and 82 respectively) own the property and have decided to sell it. They have also signed the sale agreement and taken the advance amount and taken a house on lease with the advance amount. My sister and her husband do not want the sale to happen unless the total money is in their custody to which my parents do not agree at all. They say they will decide what to do with the money. All that is pending is the transfer and registration of the property. Knowing this, my sister has taken my dad to her house without our knowledge and since then is neither accepting our calls nor is letting us speak to him. We managed to speak to him through another phone and he asked us to come and take him home, but my sister grabbed the phone and said that even if we go there, she will tell the security not to let us in. What can my mother do in this situation. Your response will be highly appreciated.

A. First try to settle the issue through your family friends and relatives.If not possible ,engage a lawyer to seek legal remedy.They cant simply detain your parents illegally without their consent.

My husband left us before 20 days. He has blocked my credit card too and he doesn’t give me cash. I survived 20 days by taking money from parents. Now all payments are due. He has blocked my no. What should I do.

A. Whether he was behaving like this on earlier occasions also.If so, you can file a case against him under domestic violence Act for cruelty and ask for monetary relief in the first instance.

when I was in class 12th in 2011 my teacher did not teach me the topics which were in the syllabus so instead of doing hard work I could not pass the exam later I passed with own labour but I lost my prestige and hope so can I complain against the teacher in any legal way

A. You cannot file complaint against the teacher. Teaching is the core function of any Educational Institution.As per the decision of the Honourable Supreme Court Education is not a commodity coming under the ambit of consumer protection Act. Moreover any complaint under the consumer protection act has to be filed within two years of the date of cause of action unless there is sufficient cause.
