Sir, I have used 3 credit cards from 2016. Am unable to pay the amount of these cards after unemployment in 2018 Feb. After a year banks calling me to pay all the due by threatening me n my family members. I said I'll pay but they won't listen. They repeatedly calling my relatives n torture everyone that ur boy is a cheater not paying bank dues n all. Now i have problem in my family n relatives. They make me scared every one that they will file non bailable case against me n sent to jail. Let me know what to do pls advice

A. Its simple that if you have taken loan (credit card here) then you will have to pay back that loan amount or the outstanding credit card amount. If you do not do so then the Credit card company or the collection company will keep bothering you and they will even initiate the legal action against you. Now what you have to do is to speak to them and try to settle the matter peacefully. Tell them that you are ready to pay in installment and gradually you shed off all your liabilities.

A. There is nothing called procedure for live-in relationships. So, don't get worried about following anything. Just remember that live-in relationships are getting recognized as marriage hence all the rules and laws will be applicable when you want to take any legal action or any legal issues crop up out of the relationship.

Loss caused to a company due to professional misconduct of an employee. Is professional misconduct treated as a tort or a contract for the purpose of right to sue legal heir upon death of deceased.

A. The beauty of Law of Tort is that wherever it is not possible to ascertain the loss or damage suffered by a person under any provision of prescribed law then the relief for such a damage or loss can be sought under the Law of Torts. Etymologically Tort means TWISTED -not straight and in legal sense it means an injury, wrong or injustice. In your case if the employment contract mentioned about professional misconduct as part of the terms and conditions and the related damages or penalty then it would come under the law of contract. And under this law only the employer can be sued or penalized but not the legal heirs. Depending on what kind of injury the other party has suffered if they want to sue the legal heirs of the employee then on high level, as per my understanding it can be done under the Law of Torts.

A. Dear Client you are requested to post complete matter about your case then a lawyer can give some advice. Please be advised that finding about the case timeline is not that easy as it depends on various factors. You should speak to your current lawyer and try to find out on it. In general a lawyer can give you some information if you tell complete story on the case.

I am a GOVT SERVANT in ARMED FORCES and my wife has lodged complaint against me in my department pertaining to dowry and domestic violence etc which is absolutely false. MY department is not giving me copy of complaint officially and as well as means of RTI, saying that it is exempted being Armed forces. In what all ways I can get a copy of it as the enquiry date is nearing by. Kindly guide pl.

A. Has your department taken any action on the complaint? As and when they do so they will disclose the details to you or else you can demand it to be disclosed. They cannot persecute you without citing the reason. So don't worry.

I had married on 22.09.16 .as per Hindu special marriage act we have applied for registry on 22.08.16 before one month of my marriage and registration has made on 22.09.16. After one year of my marriage I came to know that my wife had married earlier and they filed for divorce on 20.09.16 as mutual consent.Court has been given order for their decree of marriage on 20.08.17 and order has mentioned that they are not living together more than one year. Now I will be proved that my marriage is void at court.

A. Your question is not clear that what you wanted to ask. Assuming that you are asking whether your marriage is valid or not the answer is that your marriage is void and is not valid. Since the woman you married was still not divorced so your marriage is not valid.

Dear Sir, I am residing in an upper flat in a society. I renovated my small bath room to prevent water seepage to lower flat in April, 2018, bot the lower flat owner did not share expenditure. Now he wants that I should renovate my big bath room too to prevent seepage else he will sue me in a court. Please guide me how should I proceed. Regards, Devinder Kumar.

A. Ideally your society should have the bylaws that in such cases who will bear the expenses or how it will be shared. So first approach the society and seek their guidance. In case the other owner files a case then you fight it out as it cannot be completely your responsibility.

A. You can ask your son to authorize you ( or if needed issue a PoA) to represent him in the apartment society and then you can start intervening in the forum in the rightful manner.

A. Collect all the details about that person and send him a legal notice and a copy to the Patanjali as well. Simultaneously file a police complaint in the near by PS for fraud and let them act on it.

A. Straightway file a consumer case and seek compensation and damages from the railways. If they have faultered in delivering the services and have caused loss to you and you property due to deficient services then they must be made to pay via proper proceedings at the competent court.
