I got married in hyderabad in 2008 through Arya samaj and it was a love marriage against family and the marriage was not court registered after 1 year I got to know that she is a character less women having illegal physical relationships with different mens and when i console her abt this y u have cheated betrayed me then she said that from early days she used to do this and but even after this i forgive her and given a chance to correct herself but she didn't and doing the same again and we have a kid of 7 years and unfortunately I was met with an accident in 2014 and i had a serious head injury due to which my body got paralyzed and im on bed completely and even after this she didn't even came to care see me and later she said she will keep kid custody with her life long and now from 2014 to till date we have no relationship and living separately and she had all arya samaj marriage certificate and photos with her Please advice can I get marry with another marriage

A. You need to file suit for decree of divorce. Go for mutual consent divorce if she agrees.

My wife filed a case against me, after living separately for 11years.She is doing a private job with 1.5 lacs/month salary. She filed for divorce and one time settlement. I attended the court in the first summon. Since then I was never summoned or informed about the court proceedings or dates or even about the final judgment/decree.Now I received a summon after one year, as to why I didn't pay the sum of 10 lacs as ordered by court .

A. It means that though you had accepted summons and attended the first date of hearing but it appears that you did not file your written statement, nor contested the suit. You need to get a copy of the decree from the court and if you wish challenge it before Hon'ble High Court. Contact any local Advocate from this portal.

I'm married for 8yrs and mine is inter religion marriage and was in a joint family with in laws . Now my sister in law got married and my brother in law ran away since his business went in loss and because of these 2 people my husband was into a debt of 15 lakhs and he closed that after working in abroad for 3 yrs and now he is back. In these 3 yrs I was taking care of my 3 kids, his mother and I was working too. My father in law is not with us because of his bad behaviour and a complaint also registered against him in bangalore by me. Now the problem is my husband don't like me and he find mistake in all the things I do and he us very caring about his mother but he is always yelling at kids and me. I want to be away from him. Let him take care of his mother and I 'll look after my kids. I just want him to free meand my kids and let us live. What needs to be done .

A. Discuss with him and explain to him your difficulties. Suggest that you stay with kids separately for some time, maybe in a nearby location. If everything fails, then suggest for mutual consent divorce, and if he does not agree, go for divorce on ground cruelty and other grounds based on your experience.

i am 31 yr hindu male..i hv married 1 yr ago....now my wife n her relatives are defaming me orally in d society as impotent .... 1)as it is slander defamation, can i file defamation case against them? will it be effective or should i wait till they make written impotency allegations against me in d court? currently i am telling them to put a petition on the basis of impotency and get divorced.... 2)what if they dont mention the impotency in divorce case and ask for divorce on other grounds? because i want to prove myself as potent... 3)consider the scenario- if she filed divorce case without mentioning impotency and my lawyer asked her in front of magistrate in the court that is your husband impotent or potent- yes or no?.... and she said that my husband is impotent....then will it be legible defamation?...will her statement in the court hv equal importance as written statement?? So plz guide me what should i do??

A. Mutual consent divorce. Under Section 13-B of the Hindu Marriage Act, 1955, the parties can seek divorce by mutual consent by filing a petition before the court. Mutual consent means that both the parties agree for peaceful separation.

Hi my husband left in 2010 March and till now I couldn't find him any where can i go for 2nd marriage. The 2nd marriage people asking the divorce papers which i didn't apply, but i need it in emergency in 1 week any alternative option, if not I will miss this wonderful proposal can you please suggest

A. First file petition for divorce on grounds viz. - he has deserted you for a continuous period of not less than two years immediately preceding the presentation of the petition; and - he has not been heard of as being alive for a period of seven years or more.

My wife and I are living separately for the last 8 years. I am attending to the requirements of my two children who live with her. She is earning equal to me. She is not willing for divorce with mutual consent. Is it possible to file for divorce without going into instances of cruelty etc and just stating that we have been living separately for 8 years. Is ut easier to get a legal separation?

A. File divorce petition with the factual situation, if there is no cruelty. Based on the facts, there is cruelty because the family is living separately.

Me and my husband are married for 5 years, with a 21 month old son.. My huband, lied to me before marriage about his education and his work.. During the complete 5 years of marriage, he was sitting at home and doing nothing.. And all that frustration he took out on me and my Family.. He abused me badly in all the 5 yrs of marriage and also my parents.. Due to all this, after 2 and half years of marriage i started chatting to my ex (creating a fake email id), whenever i was at work.. i met him twice during the course we were talking in public.. I spoke to him (through chats and phone calls only as he stays in Banglore) from approx Aug 2014 till Jan 2016.. After which i got pregnant and stopped talking to him.. again after couple of years he called me up in Nov 2017, just to check on how i was doing and inform me that he's getting married.. but since i was going through a very bad phase in my life (as by then i have left my husband's home 3 times and got back as they apologised), on one of the days i got very romantic in the chat we had.. and also sent him my intimate pictures when he asked me for it..This was in Jan 2018.. One day, (I believe Feb 8, 2018), my husband saw something in the history about that fake email id, and i had to give him the password of that id, deleting evrything in it.. But my husband fought with me over that and since i also tired of his abuses n behavior i left his home.. Next day, he recovered all teh chats n email i had with my EX talking to google guys, and he strted thretening and torturing me to leave my job n compromise with him,,, but i didn't do that.. now it's been close to 6 months i am away from my husband, but he's still using those chats to torture me and threaten me that he'll take my child's custody.. Child is with me since last 6 months and my husband also doesn't earn anything.. he just sits at home while spending his father's earning.. Is there a chance he can get child's custody if we file a case in the court.. and can i get any alimony amount in this case

A. Child custody will not go to him. So also, you may not get alimony as he does not earn, as per your statement.

I'm a Medical Officer working in a Municipal corporation of 48 years & am married for last 22 years. Because of certain incidences, My wife who is lecturer in a Private Medical College, has minimised her interactions with her in laws & doesn't interact on her own with my parents. There isn't intimacy in our life & we are living together just as parents of our daughters. Since last 17 years we are living in a sexless marriage.(< 3 episodes of physical intimation in a year against normal of at least once in 45 days) I had attempted to have dialogue with her in vain. When I try to be intimate with her, there is always resistance from her & she has never got intimate with me anytime in whole married life. As she isn't interested in continuing Married life but not taking any further step, just because of loosing Alimony, Can I give legal notice to her to file a Divorce case? If I give her a legal notice, Can she frame me & my parents or my brother in IPC 498 or specifically me in 497 without any proof? Would the legal notice safeguard me in such falsified cases? Does such legal notice useful to refuse alimony to Divorced wife?

My son was married in 2010 and was registered in Bhubaneshwar, Orissa where he was posted then. My son and his wife both are working and in 2014, his wife was sent to on site to USA and he was sent to USA in 2015 by their respective companies. In early 2018, his wife wanted divorce and a suit was filed in a court in Texas, USA where they are residing And Texas court granted the divorce plea without any obligation whatsoever to either parties. They have no issue. If my son is to get married again in India, is there any further formalities, legal or others, to be followed in India?

I am a lady 32 year old married since 1.5years, i tried a lot but my marriege coudnt get consumed yet, my husband medical reports is normal but he doesn't want sex with reason there is no love, ours is an arranged marriage, after done marriage in india we came to london and living here, marriage certified in india only, i want to get divorce with alimony but he is not ready, we are still living together in london under one roof without sex, plz advice wat to do, i dont want to waste my life here, my question is- can it be ground of divorce when reports are normal but sex nver done by husband, he argued me daily which I recorded in which he is saying he will not do sex till there is no love, if u seeking sex then go to kotha or be sex worker. Can it be proof of cruelty? Plz advice soon and real! - prach Arora (on spose visa, husband have green card uk)?
