A girl loves a married man and wants to live with him. Her family is against it and they are not allowing her in doing job outside or moving out. Now the girl is planning to leave home and move to the man by her own choice. Does the married man is advisable to help her in this crisis time or does doing this will draw any offence?

A. Bigamous marriage is an offence even if it is performed with the consent of the first wife. Not advisable to marry a married man when the previous marriage is subsisting and is not divorced by a decree of Court of Law.

Dear Sir, This informs that, My wife had issues with her health (paranoid thinking problem ). Currently, she is planning to do a mary someone with her family member support. We having a one-year-old baby. She is not stable mind from the beginning and I am having physiatrist doctor's proof. I need to recover my baby. Please suggest me to proceed

A. File for divorce and seek custody of child. She cannot marry again without first divorcing you.

I married in Nov 2016. Have a baby; 10 months old and diagnosed with Acute Leukamia. To avoid medical expenses, my husband simply left me to handle the situation alone. I am unemployed. The child is undergoing chemotherapy. T Do I have any legal possibility to handle the situation. In case of divorce, am I entitled to a right to properties belonging to my husband?

A. Try to resolve it amicably, and try to get sufficient alimony for you and expenses for child's welfare, maintenance and eduction. If not possible, then you need to file for divorce and claim for alimony for you and expenses for child. Take assistance of local Advocate.

I got married to a boy before 5 years and now i divorced him legally. Now I planned to do my second marriage whether the marriage certificate holds the details about first marriage? Only my fiance knows about my 1st marriage. I am so confused. If any of the details about my 1st marriage will be mentioned in second marriage certificate? I am now going to register my marriage in Tamil Nadu. Also I have registered my 1st marriage in tamilnadu and got divorced.

A. Yes it is possible. Contact local Advocate for legal assistance. Under section 13(1)(iii) of the Hindu Marriage Act, 1955, the grounds are: if the person if incurably of unsound mind, or suffering continuously or intermittently from mental disorder of such a kind and to such an extent that the petitioner cannot reasonably be expected to live with the respondent. (a) the expression mental disorder means mental illness, arrested or incomplete development of mind, psychopathic disorder or any other disorder or disability of mind and includes schizophrenia; (b) the expression psychopathic disorder means a persistent disorder or disability of mind (whether or not including sub-normality of intelligence) which results in abnormally aggressive or seriously irresponsible conduct on the part of the other party, and whether or not it requires or is susceptible to medical treatment; the marriage can be dissolved by decree of divorce.

If we win case file 498a, then if compromise , I go to live again my matrimonial house, if they again try to tourture me, can I do again file 498a case?what will action then? Should I do compromise and go to live at matrimonial ?

Sir, My wife is alleging DV in divorce, 498a etc, maintenance but she did not filed any separate case of DV against me since she separated from 2016. Is there any benefit of non filing of DV against me in other cases.

A. DV case be filed any time. There is no statutory limit for filing of case under section 498A or Domestic violence, however, one has prove the 'violence' or 'continuation of violence' in such cases. The burden of proof always lies on the complainant.

A. You can lodge a police complaint u/s.498A of IPC against your husband and in laws (if they are also involved) for subjecting you to cruelty and physical and mental torture. You can also file a DV case asking for residential right, maintenance (if you are unemployed), protection etc. Thereafter, you may be able to go for a mutual consent divorce against lumsum amount as compensation. Any local advocate's legal assistance.

My mother in law stays with me The flat in which we stay is in the name of my husband but my father in law had paid 60% and my husband 40%. My brother in law stays separately But my mother in law wants to give him share in this property in spite of not at all staying with him. Secondly there in another flat in the name of my mother in law. Can you please advise how much share is my brother in law eligible to get in both the properties even though my mother in law is not going to stay with him

A. It is not like who lives where. The issue is if it is a family property i.e. ancestral property then all heirs will have equal share in such properties. If it is self acquired, then only the owners have right in that property. As regards your bro.in law, if the property is acquired by your mother in law and your father in law, then he (bro.in law) will have right to share in that property in future, unless it is disposed of by them during their life time.

A. Talk it over to your wife if it can be resolved and whether you both can continue the marriage. Or file petition for divorce by mutual consent. If not possible, then file divorce on the ground of adultery. Keep / preserve / produce proof which are in your possession.
