Hi, this is for a friend. He is married and has a respectable position in the society. One of his aquaintance has lodged an FIR of wrong fully holding her hand and of sexual mis conduct. Both my friend and this lady are married and I beleive they both are already involved extra maritally. In a lower court he got convicted and sentenced for 5 yrs, now he is challenging the same in the higher court. My question is if a known aquaintance and that too if two people already involved physically one of whom decides to do lodge an FIR..how this can be proved to the court that this is not a forceful conduct?

Hello, After finding out cash-for-sex is legal in India, My friend introduced me to a lady who is into prostitution as she needs huge money.Then I had sex with her for some money in a private place. After knowing what I've done is completely legal after reading ITPA act 1956 and SITA 1986, the lady herself asked me to refer some of my friends. My doubt is will i be arrested for pimping/soliciting even though i got her permission ? (There was no physical abuse/force towards the woman) Also, SITA & ITPA acts says that a woman can perform cash-for-sex in a private place but cannot solicit for customers. How can a woman get clients without soliciting or asking for referrals? Please clear my doubts

Hello, I am living in chennai and i have a long time female friend. She is into financial trouble recently and asked for my money help. I refused as i didn't have the money that she was asking for. She then told she is willing to do anything to earn some quick money and told that she is ready to have sex with me for money in return.I refused,We both are over 18 years old. Also, she is asking me to refer my friends who are willing to give money for sex. Now my question is if i refer her to my friends and they are having sex in a hotel. In case they are caught in-between police raid and if they reveal i had referred my friend to her. Will i be arrested for soliciting prostitution ?

A. First avoid sking questions like that on public platform because it is also an offence. Your proposed act of middleman is known as broker and punishable

Dear Sir, I had been trapped in fake rape matter. I got the interim from Delhi High Court as the charge sheet was filed during the hearing duration. Hence Delhi High Court grant interim till 23-7-18. We filed the anticipatory bail in sessions which was not listened properly and Hon''ble judge refused to grant bail straight away and stated that he will dismiss the bail,, hence we withdrew the bail from sessions. Now on 23rd July, MM court h/o charge sheet to us and ndoh was today. Today MM court stated that i need to go to JC according to law. We requested that kindly grant us protection till we appear in trail court, hon'ble judge refused. On request, Hon'ble judge give us time till ndoh i.e. 14/8/2018 to produce either any law or judgement where we can convince the court that MM has power to listen or decide the bail. Please suggest.

Hi, The fake rape case is made on me. I got the interim bail from Delhi high court upto 23 July 2018 because the charge sheet had filed in the court of ACMM and on 23rd July ACMM had put on scrutiny and copy of charge sheet handed over to me and ndoh given for 7th August 2018 . We applied the anticipatory bail in sessions court and court adjourned and ndoh is 27th July. Earlier at the time of NBW cancellation, police stated in court that i joined the investigation and cooperating in investigation. Now i am guided that either the court will dismiss or we have to withdraw the bail tomorrow. Please confirm that 1. Now we mandatory need to withdraw the bail from Sessions court or we fight and ask the court to dismiss it. 2. Is there any law that we need to apply bail in the trail court only after committing the file from ACMM court to Sessions i.e. trial court. 3. Is there any loss if we withdraw bail tomorrow

A. hello sir ,your anticipatory bail chances has been nulled. you should go through regular bail application and even you may apply to court for granting interim bail relief.

Sir a person arrest by the police under section 354/509 I.P.C and under POCSO act.How may days need to get bail sir ?

DEAR SIR, I AM A VICTIM OF FAKE RAPE CASE ALLEGED BY MY FAMILY FRIEND WITH COLLUSION WITH MY WIFE. I APPLIED BAIL WITH ASJ THAT WAS DISMISSED. THEN WE FILED TO HON'BLE HIGH COURT OF DELHI AND FROM SEPT. 2017 TO 6 TH JULY 2018 WE GOT THE FINAL ORDER THAT "LEARNED APP FOR THE STATE HAS INFORMED THAT CHARGE SHEET HAS ALREADY BEEN FILED IN THE COURT OF METROPOLITAN MAGISTRATE ON 05/07/2018. THE MATTER COMING UP ON 23.7.2018. THE COUNSEL FOR THE PETITIONER SUBMITS THAT HE MAY BE ALLOWED TO WITHDRAW THE PRESENT PETITION BUT THE INTERIM PROTECTION AGAINST ARREST WHICH WAS EARLIER ORDERED MAY BE EXTENDED TILL 23.7.2018 WHEN THE PETITIONER INTENDS TO APPEAR BEFORE THE COURT OF COGNIZANCE. THE PETITION ALONG WITH ACCOMPANYING APPLICATION IS DISMISSED AS WITHDRAWN. THE INTERIM PROTECTION AGAINST THE PETITIONER SHALL ENURE TO THE BENEFIT OF THE PETITIONER TILL 23.07.2018." Please confirm following What is the next process. Is there any chance of arrest after 23.7.2018. Shall i file regular bail earlier than 23.7.2018 Is there any chance of bail getting dismiss. As charge sheet is submitted in ACMM Court and IO told me to appear in the same court. So we need to apply regular bail in the same court or ASJ /Sessions court is only authority to grant me bail?

I'm the victim and I'm 17 years old and yesterday I lodged a fir againstmy molester, he has been charged under the follow sections 376 2n 506 323 4 6 8 10 12 Will the accused get bail ? Because if he does then that is life threatening as he has given me death threat ( I even have its recordings) Also any idea how many years punishment he might get ?

A. Dear Madam, Just approach the concerned I.O. and Public Prosecutor and request them to make strong objection for granting bail You must alos present before the Court and submit orally that you have life threat if he is granted bail.
