Sir, I have deposited Rs 2 lakh (cheque) in society in bangalore for allotting sites. Along with that one of the agent from Land developer side taken Rs 2 Lakh cash from me and other 2 ppl promising that he will get the site. But now society is not saying that they will not be in a position to give the site to us saying that we are from developer side.
The agent was till now saying that he will return the money taken by him with interest as on date. But now he is saying he will give only Rs 2 lakh +1 lakh only. If we see Bank interest it will be around 5 to 6 Lakhs. Now he stopped recieving the call. We know about his working place. How to go ahead for repair. We do not have any proof for paying money. Whats app messages are there by no reply from his side.

A.you need to send money recovery notice to agent since he had taken money also mention in notice that within 15 days kindly deposit all money.

A.If you have documentary evidence for paying the amount to Society you have right to insist on giving ( allotting ) you the site that is promised in the recipit / acknowledgement. And you can recover whatever amount you have prrof of paying.

Sir, Can we claim for refunding about total Rs .9 lacs as on date. This is considering 14 % pa bank lending rate for principle of Rs 2 lakhs.( initial 2 lakh paid in May 2006)

We had recent meeting with society, they are not clear whether they can give site or not . When we asked for refund society Vice president said he alone cannot take decision on this and more over there is no rule in societies to refund the money with interest for any no year delay. He said me to send a letter to society about our concern if we are interested to withdraw. They will put up in their upcoming AGM on 22nd sept. Kindly advice how will we go ahead. Please also intimate that what is the cost of sending legal notice in case required.

Elsewhere you stated that you have no record for having paid the amount , is it so ?

I charge Rs. 1500/- for issuing notice.

Sir,
Actually we have got know the society details from developer's person . During those days in yr 2006 he has taken Rs. 2 Lakh advance separately from us apart from soceity paid site deposit of Rs. 2 Lakh. We dont have reciept for the money paid to developer side person. Recent meeting he had agreed to pay back money of Rs 3 lakh against 2 lakhs what we paid . But we are insisting for interest for that amount also till date. But now what we understood that there is no link between soceity and that person other than he is from developer side. But developer and society are fighting in court for some other issue. Kindly suggest what is the best way out. If you can provide your phone number / email id I can brief you fully. Will you take up this case. The necessary amount will be transfered throu online. I request the legal notice should go at the earliest as their AGM is on 22nd sept18. Regards, Prakash

There is no evidence for having paid the money. In this condition can we issue a legal notice ? But I have a friend who was there at the time of handing over money to him. He will witness. Shall I give police complaint for the this?

A.First collect the money offered by the agent and pursue for collecting the remaining amount through a property professional lawyer.

sir , since we paid cash and there is no receipt or evidence, How can we go ahead. How can we encash our till date amount from society. My totall loss is about 25 lakhs based on appreciated cost at present. Can we sue the society and this agent together
