I got married in Nov 2013. After marriage I came to know that my husband has no money he was having his personal loan, credit card dues are pending. He didn't told about this before marriage. After a year we shifted to Pune then I came to know that he cheated me about his education. He told me his education was MBA but in reality he was told me wrong.. He was not MBA holder. Later that I come to know that his younger brother was scrizophenia patient. My husband has habits drinking & smoking.. He has no savings, no investments.. I everytime informed his parents about his habits but they are least interested. Even my husband is not ready to do physical relations he gave always a reason for the same.. Finally I took a decision for legal separation.. But my husband was not ready for this also. He was just saying u stay without any legal formalities. I ask for alimony but he was not ready to pay. Even his parents are now saying that we are not responsible for this whereas at marriage my in laws are demanded money. My father has gave them 2.5lac at the time of marriage. That cheque was deposited at my Father in law Bank account. Please help me what I do? I don't want any court matters. I want to do mutual consent divorce. But my husband and my in laws are not supportive..

Just stay away without divorce if you can. If you wish marry for second time then only divorce is necessary.

On the very first instance you go and reside with your parents because for filing of divorce separation is must.
Then you send legal notice upon your husband for demanding the mutual divorce if he ready for same then ok otherwise you go by contest.

Divorce may be obtained by mutually or by contest....ie some grounds.First send notice for divorce accordingly you may act.
